A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA APPROVING CONDITIONAL USE PERMIT NO. 2019-14 AS <br />CONDITIONED TO ALLOW AFTER HOURS OPERATION FOR AN IN-N-OUT <br />BURGERS LOCATED AT 815 NORTH BRISTOL STREET <br /> <br />General Notes: Legal notice published in the Orange County Reporter on May 3, 2019 <br />and notices mailed on May 2, 2019. Matter was continued from the May 13, 2019 <br />meeting by a vote of 6:0 (Alderete absent). Decision on this matter is final unless <br />appealed within 10 days of the decision by any interested party or group. <br /> <br /> <br />3. 2019 LOCAL GUIDELINES FOR IMPLEMENTING THE CALIFORNIA <br />ENVIRONMENTAL QUALITY ACT {STRATEGIC PLAN NO. 5, 2} – Selena Kelaher, <br />Case Planner. <br /> <br />REQUEST: The State CEQA guidelines require local agencies to adopt “objectives, <br />criteria and procedures” to implement the requirements of CEQA and the State CEQA <br />guidelines (State CEQA Guidelines [14 Cal. Code Regs.] Section 15022). The 2019 <br />local guidelines for implementing the State CEQA for the City of Santa Ana reflect <br />recent changes to the State CEQA guidelines and relevant court opinions. <br /> <br />ENVIRONMENTAL DETERMINATION: The proposed project is not a project under <br />State CEQA Guidelines section 15378(b)(5) because it involves an administr ative <br />activity involving process only and would not result in any environmental impacts. <br /> <br />RECOMMENDED ACTION: Adopt the following resolution. A RESOLUTION OF <br />THE PLANNING COMMISSION OF THE CITY OF SANTA ANA RECOMMENDING <br />THAT THE CITY COUNCIL ADOPT LOCAL GUIDELINES FOR IMPLEMENTING THE <br />CALIFORNIA ENVIRONMENTAL QUALITY ACT (PUBLIC RESOURCES CODE §§ <br />21000 ET SEQ.) <br /> <br />General Notes: Legal notice published in the Orange County Register on May 17, <br />2019.
