FIRST AMENDINUNT TO AGREEMENT TO PROVIDE TROLLEY SERVICES <br />FOR DOWNTOWN SANTA ANA EVENTS <br />THIS FIRST AMENDMENT TO AGREEMENT is entered into on this 22nd day of August 2019, <br />by and between Dulac Enterprises, dba Big Red Bus Charter, a California. Corporation ("Consultant"), and the <br />City of Santa Ana, a charter city and municipal corporation duly organized and existing under the Constitution <br />and laws of the State of California ("City"), <br />RECITALS <br />A. The parties entered into Agreement #N-2019-058 dated April 1, 2019 ("Agreement") by which <br />Consultant agreed to provide trolley transportation for Downtown Santa Ana events. The Agreement runs from <br />April 1, 2019.through March 31, 2020 and is current and in effect. <br />B. The parties have agreed to provide additional services for the City's Annual Fiestas Patrias event <br />scheduled for September 15, 2019 and increase the compensation to the Agreement to pay for costs related to <br />these additional services. <br />Now, therefore, in consideration of the mutual and respective promises, and subject to the terms and <br />conditions of said Agreement, except as herein modified, the parties agree as follows: <br />1. Section 1, SCOPE OF SERVICES, shall be amended to add to the scope of services for <br />Consultant to provide trolley services on September 15, 2019, as noted in the attached Exhibit A-1 to the <br />Agreement. <br />2.. Section 2, COMPENSATION, shall be amended to increase the not -to -exceed amount by $1,400 <br />to $17,750. This amount shall include the rates and charges identified in invoice #8219, attached hereto as <br />Exhibit A-2. <br />3.
