g. No one under the age of twenty-one (21) shall be allowed to enter an Adult - <br />Use cannabis facility unless the licensed Adult -Use cannabis facility holds a <br />medicinal use cannabis RSP issued by the City and retail license issued by the <br />State, and the licensed premises for the adult -use cannabis license and <br />medicinal cannabis license are the same in accordance with Business and <br />Professions Code section 26140. <br />h. If non -cannabis food is distributed, the retail business shall comply with all <br />relevant State laws, County and City ordinances pertaining to the preparation, <br />distribution and sale of food. <br />i. All Adult -Use cannabis retail businesses shall establish and implement a <br />program to incentivize the recycling of used containers. Failure to establish and <br />implement a program to incentivize the recycling of used containers will result in <br />a violation of the terms of the required commercial cannabis Operating <br />Agreement requiring sustainable building or business practices. <br />j. Adult -Use cannabis retail businesses shall also record on the video <br />surveillance system point -of -sale areas and areas where cannabis goods are <br />displayed for sale. <br />k. Adequate signage shall clearly state who has inspected any cannabis <br />product for pesticides, or other regulated contaminants, distributed at this <br />location. <br />I. Shipments of cannabis goods may only be accepted during regular business <br />hours. <br />m. Inventory shall be secured using a lockable storage system during non - <br />business hours. <br />n. No cannabis product shall be visible from the exterior of the business. <br />o. All required labelling shall be maintained on all product, as required by State <br />law, at all times. <br />p. Educational tours of adult -use retail cannabis businesses shall be allowed. <br />q. A permitted commercial cannabis retail business shall have one hundred <br />eighty (180) days after permit issuance by the City of Santa Ana to operate. A <br />permitted commercial cannabis retail business that ceases to operate for more <br />than ninety (90) calendar days shall be deemed "abandoned" and the permit <br />shall be forfeited. A permitted commercial cannabis business may temporarily <br />suspend operations for a period of time as may be reasonably required to affect <br />upgrades, modifications, repairs, or other property issue mitigations as approved <br />by the Director of Planning and Building or his or her designee. For the purposes <br />of this section, 'operate" shall mean that the gross receipts fees charged for the <br />R-3 <br />11 B-18 <br />
