INSURANCE NOT ON FILE <br />WORK MAY NE PROCEED <br />CLERK OF COUNCIL <br />® DATE: SEP 0 4 2019 <br />0 1 Q L5Q (i) FIRST AMEl <br />5 ,\Niw CHearwj OPERA? <br />A-2019-138 <br />THIS FIRST AMENDMENT to the above -referenced Agreement is entered into on August 20, <br />2019, by and between Match Point Tennis Academy, LLC, a California Limited Liability Company <br />("Match Point"), and the City of Santa Ana, a charter city and municipal corporation organized and <br />existing under the Constitution and laws of the State of California ("City"). <br />RECITALS <br />A. The parties entered into Agreement No. A -tor a-2os dated September 4, 2018 to provide for the <br />management operation, maintenance and concessions by Match Point at the City's Cabrillo <br />Tennis Center ("Agreement"). <br />B. The parties wish to amend the Agreement to provide for a month -to -month term starting September <br />5, 2019 until December 31, 2019. <br />The Parties therefore agree: <br />1. Section 2, TERM, of the Agreement is amended to provide that as of September 5, 2019, the <br />Agreement term will be month -to -month until December 31, 2019, unless terminated earlier <br />pursuant to the terms of the original Agreement. <br />2.
