The Conklin’s own an <br />express car wash called Speedie Clean Express Car Wash (hereinafter, “Speedie Wash”), located at 2035 <br />N. Tustin Avenue. Speedie Wash is 1.2 miles from the Project, and on the same side of the Tustin <br />Avenue. <br />The Conklin’s oppose the Project for the following reasons, which are explained in detail below: <br />(1) The Project does not meet the factors required for approval of Conditional Use Permit No. 2019-30 <br />(the “CUP”); (2) Notice of this Planning Commission meeting was inadequate for the Conklin’s or any <br />other affected persons to adequately respond; (3) The project proposed in 2018 by Applicant, Russell <br />Fischer LP, through which a zone change and General Plan Amendment pertaining to the Project <br />properties was obtained, was a pretext for the subject car wash expansion and should be investigated; <br />and (4) the Project is not categorically exempt under the California Environmental Quality Act <br />(“CEQA”), and environmental review is required under CEQA.
