10.0 OTHER LEAVES OF ABSENCE <br />10.1 Sick Leave. <br />A. Definition. Except as otherwise provided below, sick leave shall be deemed to <br />mean absence from duty of an employee because of illness, injury, medical, or <br />dental appointment that prevents the employee from performing the duties of his or <br />her position, and shall be deemed to include time in quarantine resulting from <br />exposure to a contagious disease. <br />B. Accrual. Each employee shall be entitled to, and shall earn, one (1), eight (8) hour <br />working day of sick leave for each full calendar month of service in which he is <br />employed by the City with full pay; provided, however, any absence on sick leave <br />for a period of time greater than fifteen (15) consecutive calendar days in any one <br />(1) calendar month shall not be considered to be service entitling an employee to <br />earn sick leave as aforesaid. Subject to the other provisions in this Article, sick <br />leave shall accrue to the credit of each employee to the extent that it is not used. <br />C. Authorized Only When Necessary. Use of sick leave by City employees shall be <br />authorized as follows: <br />I . Sick leave is not a right which an employee may use at his or her discretion, <br />but shall be allowed only in cases of necessity and actual sickness or <br />disability, or as authorized in Subsection J below. <br />2. When an accepted industrial illness or injury has caused an employee's <br />absence, for which benefits are required under the State Workers' <br />Compensation Insurance and Safety Act, paid sick leave will be allowed <br />such employee during the first three (3) days of the statutory waiting period. <br />If the workers' compensation related illness or injury continues past the <br />initial three (3) consecutive days, the employee will have the three (3) used <br />sick days recredited to his or her account, if the employee remains off work <br />longer than 14 days. Paid sick leave will continue until the fourth (41h) day <br />when the City pays the employee workers' compensation benefits for such <br />illness or injury. If the employee does not have sufficient accumulated sick <br />leave at the commencement of such industrial illness or injury, they will be <br />advanced sick leave for this purpose.
