Adopt with the misdemeanor penalty as originally proposed in the First Reading of the <br />Ordinance, <br />KO <br />2. Alternatively adopt without the misdemeanor penalty as amended by the City Council in the <br />First Reading of the Ordinance. <br />DISCUSSION <br />During the Introduction and First Reading of the Ordinance, a Council Member requested the <br />removal of the penalty provision making a violation of the ordinance a misdemeanor. Upon further <br />discussion with the Santa Ana Police Department and the City Attorney's Office, staff recommends <br />retaining the misdemeanor provision in the ordinance for the second reading. <br />The ordinance, as written, provides officers the discretion to issue an administrative or <br />misdemeanor citation. However, if the issuance of an administrative citation does not achieve <br />compliance, in order to bring the matter before a judge for prosecution, the officer must issue a <br />misdemeanor citation. <br />Staff is seeking Council's support to retain the misdemeanor option as an enforcement tool in this <br />Ordinance. <br />STRATEGIC PLAN ALIGNMENT <br />Approval of this item supports the City's efforts to meet Goal #5 - Community Health, Livability, <br />Engagement & Sustainability, Objective #4 (Support neighborhood vitality and livability). <br />11 A-1 <br />
