REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />OCTOBER 15, 2019 <br />TITLE: <br />APPROVE A GROUND LEASE <br />AGREEMENT IN SUBSTANTIAL FORM <br />WITH RANCHO SANTIAGO COMMUNITY <br />COLLEGE DISTRICT FOR A PORTION OF <br />CENTENNIAL PARK KNOWN AS THE <br />SANTA ANA COLLEGE -SCHOOL OF <br />CONTINUING EDUCATION <br />{STRATEGIC PLAN NO. 5, 4A} <br />CLERK OF COUNCIL USE ONLY: <br />❑ <br />As Recommended <br />❑ <br />As Amended <br />❑ <br />Ordinance on 1" Reading <br />❑ <br />Ordinance on 2nd Reading <br />❑ <br />Implementing Resolution <br />❑ <br />Set Public Hearing For <br />CONTINUED TO <br />/s/ Kristine Ridge FILE NUMBER <br />CITY MANAGER <br />RECOMMENDED ACTION <br />Authorize the City Manager to execute a ground lease agreement in substantial form between <br />the City of Santa Ana and Rancho Santiago Community College District for continued use of a <br />portion of Centennial Park for the Santa Ana College -School of Continuing Education for a period <br />of 85 years from October 16, 2019 to October 15, 2104, subject to non -substantive changes <br />approved by the City Manager and City Attorney. <br />DISCUSSION <br />On November 5, 1979, the City Council approved a 30-year License Agreement with Rancho <br />Santiago Community College District (College) to construct and operate an Adult Career <br />Education Center (Center) at Centennial Park. The original 30-year agreement was set to expire <br />on November 5, 2009 and the parties, under the same conditions, agreed upon a 5-year <br />extension of the license in 2009 and again in 2014. On March 5, 2019, the City Council approved <br />a two-year license agreement extension with the College expiring November 5, 2021. <br />The College provides the residents of Santa Ana a unique educational resource offering adult <br />high-school diplomas, citizenship classes, English as a second language and a multitude of <br />technical career training programs. Approximately 80% of students are also residents of our <br />City. The campus is made up of portables that have exceeded their useful lives. During the past <br />several years, the College has requested a long-term license agreement in order to make <br />substantial improvements to the campus. However, the National Park Service (NPS) would not <br />approve a long-term license agreement because they found that the operation of the Center did <br />not comply with the deed restrictions for the land upon which the College is located in Centennial <br />Park. The deed restrictions provide that the property must be used for a public park and public <br />recreational area despite the operation of the College for several decades.
