COMMERCIAL GENERAL LIABILITY

<br />websites for others; or
<br />(3) An Internet search access, content or
<br />service provider.
<br />Novvever, this exclusion does not apply to
<br />Paragraphs a.(1). (2) and (3) of the definition of
<br />"personal injury".
<br />For the purposes of this exclusion:
<br />(1) Creating and producing correspondence
<br />written in the conduct of your business'
<br />bulletins, financial or annual reports, or
<br />newsletters about your goods, products or
<br />services will not be considered the
<br />business ofpublishing; and
<br />(2) The placing of frames, borders or links, or
<br />advertising, for you or others anywhere on
<br />the Internet will not, by itself, be considered
<br />the business of advertising. "broadcasting"
<br />or publishing.

<br />"Personal and advertising injury" arising out of
<br />an electronic chatronm or bulletin board the
<br />insured hosts or owns, or over which the
<br />insured exercises control.
<br />U' Unauthorized Use Of Ammthar's Name Or
<br />Product
<br />"Personal and advertising injury" arising out of
<br />the unauthorized use of another's name or
<br />product in your e-mail address, domain name or
<br />mnetetag, or any other similar tactics to mislead
<br />another'spotential customers.
<br />"Personal and advertising injury" arising out of
<br />the actua, alleged or threatened discharge,
<br />dispensa|, seepaQa, rnigradmn, release or
<br />escape of''poUutants''atany time.
<br />Any loss, cost orexpense arising out ofany:
<br />(1) Request, demand, order or statutory or
<br />regulatory requirement that any insured or
<br />others test for, monitor, dean up, nemVve,
<br />conbain, tnesd' detoxify or neutna|ize, or in
<br />any way respond to, mrassess the effects
<br />of, "poUutants";or
<br />(2) Claim or sub by or on behalf of any
<br />governmental authority or any other person
<br />or organization because of testing for,
<br />monitoring, cleaning up, namoving,
<br />conbaining, tnesding, detoxifying or

<br />neutralizing' or in any way responding 0o,mr
<br />assessing the effects of, "pollutants".
<br />o. War
<br />"Personal and advertising injury" arising out of:
<br />(1) War, including undeclared or civil war;
<br />(2) Warlike action byamilitary force, including
<br />action in hindering or defending against an
<br />actual or expected atback, by any
<br />government, sovereign or other authority
<br />using military personnel orother agents; or
<br />(3) |nsurnection, nabe||ion, revn|ubnn, usurped
<br />power, or action taken by governmental
<br />authority in hindering or defending against
<br />any ofthese.
<br />"Personal and advertising injury" arising out of
<br />any actual or alleged violation of any law that
<br />restricts or prohibits the sending, transmitting
<br />ordistributing of"unsolicited cVrnmunicadon".
<br />q. Access Or Disclosure Of ConfidenitaU Or
<br />Personal Information
<br />"Personal and advertising injury" arising out of
<br />any access to or disclosure of any person's or
<br />orQanizadon's confidential or personal
<br />information.
<br />r. Asbestos
<br />(1) "Personal and advertising injury" arising out
<br />of the actual or alleged presence or actua,
<br />alleged nrthreatened dispersal of asbestos'
<br />asbestos fibers or products containing
<br />asbeshns, provided that the "personal and
<br />advertising injury" is caused or contributed
<br />tmbythe hazardous properties ofasbestos.
<br />(2) "Personal and advertising injury" ahsingout
<br />of the actual or alleged presence or actual,
<br />alleged orthreatened dispersal ofany solid,
<br />|iquid, gaseous or thermal irritant or
<br />contaminant including smoke' vapmrs,
<br />snot, fumes, adds, a|ka|is, chemicals and
<br />waste, and that are part of any claim or
<br />"suit" which also alleges any "personal and
<br />advertising injury" described in Paragraph
<br />(1) above.
<br />(3) Any loss, cost or expense arising out of
<br />(a) Bequest demand, order orstatutory or
<br />regulatory requirement that any insured
<br />or others test for, monitor, clean up,
