FIRST AMENDMENT to the above -referenced agreement is entered into on <br />/ 0 2019, by and between the City of Santa Ana, a -charter city and municipal <br />corporation organized and existing under the Constitution and laws of the State of California <br />("City") and RobeitDaniel Walker ("Seller'', <br />RECITALS <br />A: The parties entered into Agreement No. A-2016-300, dated October 18, 2016 <br />("Agreement"),., by which :Seller conveyed to City the real property and temporary <br />construction easement as legally described in the Agreement and exhibits thereto ("Property <br />Interest"), in connection with City's Bristol Street Widening Project. <br />B. There are improvements within 'the Property .lnterest, including site improvements <br />{"Improvements"), that were not compensated under. the Agreement and. for which City now <br />wishes to compensate Seller. <br />The Parties therefore agree: <br />1. Section 6, Paynieat of Purchase Price, is, amended to include the additional amount of one <br />thousand five hundred dollars ($1,500i00) as payment by City to Seller for the Improvements. <br />City shall pay this amount by check, and Seller acknowledges ,that this amount is just <br />compensation for the improvements. <br />2. Seller further agrees that the Improvements will be removed by City and/or its contractor and <br />will not be replaced. <br />3. Except as modified by this First Amendment, all tents and conditions. of the Agreem,ent.shall <br />remain: in full force and: effect.
