Withholding of funds: Disclosure ofpending applications <br />The recipient may not obligate, expend, or draw down any award funds until: (1) it has provided to the grant manager <br />for this OR award either an "applicant disclosure of pending applications" for federal funding or a specific affirmative <br />statement that no such pending applications (whether direct or indirect) exist, in accordance with the detailed <br />instructions in the program solicitation, (2) OR has completed its review of the information provided and of any <br />supplemental information it may request, (3) the recipient has made any adjustments to the award that OJP may require <br />to prevent or eliminate any inappropriate duplication of funding (e.g., budget modification, project scope adjustment), <br />(4) if appropriate adjustments to a discretionary award cannot be made, the recipient has agreed in writing to any <br />necessary reduction of the award amount in any amount sufficient to prevent duplication (as determined by OJP), and <br />(5) a Grant Adjustment Notice has been issued to remove this condition. <br />68. Recipient may not obligate, expend or drawdawn funds until the Bureau of Justice Assistance, Office of Justice <br />Programs has received and approved the required application attachment(s) and has issued a Grant Adjustment Notice <br />(GAN) releasing this special condition. <br />69. Limitation on Eligible Subrecipients <br />No funds under this award may be provided to the City of Santa Ana unless and until (1) the recipient and the City of <br />Santa Ann have submitted additional material to OJP concerning the City of Santa Ana's compliance with 8 U.S.C. § <br />1373, (2) OR has verified thatjurisdiction's compliance with 8 U.S.C. § 1373, and (3) OR issues a Grant <br />Adjustment Notice (GAN) to modify or remove this condition. <br />ON FOR34 400012 (REV. 4-88) <br />
