The Trustee shall furnish the City periodic cash transaction statements which include <br />detail for all investment transactions effected by the Trustee or brokers selected by the City. <br />Upon the City's election, such statements will be delivered via the Trustee's online service and <br />upon electing such service, paper statements will be provide only upon request. The City waives <br />the right to receive brokerage confirmations of security transactions effected by the Trustee as <br />they occur, to the extent permitted by law. The City further understands that trade confirmations <br />for securities transactions effected by the Trustee will be available upon request and at no <br />additional cost and other trade confirmations may be obtained from the applicable broker. <br />SECTION 4.06 Valuation; Investments. <br />(a) Method of Valuation and Frequency of Valuation. In computing the amount in <br />any fund or account, Authorized Investments shall be valued at Fair Market Value. With respect <br />to all funds and accounts, valuation shall occur annually. <br />(b) Investments Subiect to Yield Restriction. Investments in funds or accounts (or <br />portions thereof) that are subject to a yield restriction under applicable provisions of the Tax <br />Code and investments in the Reserve Account shall be valued at cost thereof, (consisting of <br />present value thereof, as determined by the City, within the meaning of Section 148 of the Tax <br />Code); provided that the City shall inform the Trustee which funds are subject to a yield <br />restriction. <br />(c) Additional Limitations. Except as provided in the proceeding subsection (b), with <br />respect to a yield restriction, for the purpose of determining the amount in any fund, the value of <br />Authorized Investments credited to such fund shall be valued by the Trustee at least annually at <br />the market value thereof. For purposes of valuation, the Trustee shall be entitled to utilize any <br />pricing services it considers reliable. The Trustee may sell in any commercially reasonable <br />manner, or present for redemption, any Authorized Investment so purchased by the Trustee <br />whenever it shall be necessary in order to provide moneys to meet any required payment, <br />transfer, withdrawal or disbursement from the fund to which such Authorized Investment is <br />credited, and the Trustee shall not be liable or responsible for any loss resulting from sale or <br />redemption of any such Authorized Investment. <br />SECTION 4.07 Municipal Bond Insurance. <br />[TO COME] <br />SECTION 4.08 Reserve Policy Provisions. <br />[TO COME] <br />SECTION 4.09 Additional Rights of Insurer; Notices and Other Information to be <br />Provided to Insurer. <br />55394.00055\32329348.3 554-39 <br />
