Pronerty Records: <br />The properties were acquired as part of various City improvement projects and <br />are being sold "AS IS". The City of Santa Ana does not provide an abstract of <br />title or survey of the property. Interested parties are able to review all available <br />property records, by appointment. <br />11. Broker Fees: <br />The City intends on negotiating directly with Proposers on the sale of these <br />properties. Proposers may employ and compensate brokers at their own <br />expense. <br />IV. PROPOSAL REVIEW <br />A. EVALUATION AND RATING <br />The criteria for evaluating the Proposals are specified in: RFP SECTION I - <br />INTRODUCTION / PROJECT DESCRIPTION. <br />B. SELECTION <br />The committee may interview the top ranking Proposers. Staff will recommend <br />authorization of a purchase and sale agreement to the Proposer who best meets the <br />scoring criteria. <br />V. PURCHASE AND SALE AGREEMENT <br />A. EXECUTION OF AGREEMENT <br />The submitted Proposal will be the basis for any negotiation of final terms which <br />will lead to a completed agreement ready for execution based on the sample <br />Agreement attached herein as Attachment 4 in the Appendix. <br />B. REQUEST FOR COUNCIL ACTION <br />Following evaluation and rating by the Proposal review committee, the Project <br />Manager will bring forth the recommended Proposals to City Council for <br />authorization. <br />VI. PUBLIC RECORDS <br />All data, documents and other products used, developed, or produced during <br />response preparation of the RFP will become property of the City. All responses to <br />the RFP shall become property of the City.
