Recommend that the City Council adopt a resolution approving and adopting an addendum to the <br />Environment Impact Report for the Transit Zoning Code Project (SCH NO. 2006071100) and re - <br />adoption of a mitigation monitoring and reporting program. <br />2. Recommend that the City Council adopt a resolution approving Site Plan Review No. 2019-01 as <br />conditioned. <br />3. Recommend that the City Council adopt a resolution recommending City Council approval of <br />Density Bonus Agreement Application No. 2019-01. <br />Executive Summary <br />Michael McCann, representing Toll Brothers Apartment Living, is requesting approval of a site plan <br />review (SPR) and a density bonus agreement (DBA) to allow the construction of a mixed -use <br />development consisting of two separate buildings located on two development sites at 114 (Site A) <br />and 117 (Site B) East Fifth Street, respectively, which would contain a total of up to 220 residential <br />rental units and 12,350 square feet of commercial space. As proposed, the project requires approval <br />of one waiver from the Transit Zoning Code's development standards through the density bonus <br />agreement pursuant to California Government Code sections 65915 through 65918 and Santa Ana <br />Municipal Code (SAMC) Section 41-1600. Staff is recommending approval of the applicant's request <br />due to the project's satisfaction of meeting the intent of the Transit Zoning Code to promote a <br />pedestrian -oriented environment with a mix of land uses and because the project will provide <br />additional affordable rental housing stock to an underserved segment of the region's population. <br />60A-30 <br />
