Point Raised. Project design elements including public art installation, undergrounding of utilities, <br />balconies, and storage areas are not clearly identified in the current proposal. <br />Response: The design, specifications, and location of these items would normally be addressed in <br />detail during the plan check process. The public art component would also be reviewed during the <br />plan check process and as stipulated in the agreement and proposed SD-93; its valuation shall be <br />equal to 0.5% of the total project construction cost. <br />Point Raised. The project should incorporate a pedestrian bridge crossing on Main and the existing <br />right-of-way cannot accommodate the proposed north and south bound turn pockets. <br />Response: The proposed design and reconfiguration of Main Street meets the Public Work's <br />standards and requirements forvehicular and pedestrian circulations. <br />Point Raised: Implementation of the project emergency access road entrance on Edgewood will <br />require removal of palm trees within the public parkway. <br />Response: The proposed project emergency access is through an existing driveway opening on <br />Edgewood at Bush. This proposed design eliminated the need to remove any existing palm trees <br />within the public parkway. <br />Point Raised. Future use of the proposed parking lot property and project setback from the <br />proposed parking lot property have not been clearly articulated. <br />Response: The proposed parking lot property along the southern edge of the site could only be <br />developed as a surface parking lot to accommodate 180 parking spaces. The parking lot will define <br />the setback. Other uses and structures on the property would not be permissible. This prohibition <br />also applies to parking structures. <br />Point Raised: The periodic review provision of the agreement is vague. <br />Response: The Agreement stipulates an annual review by the City for compliance by the developer <br />with the terms of the Agreement. The cost associated with this review is to be funded by the Owner. <br />The Agreement authorizes the City Manager to stipulate and determine the information necessary <br />for the review that will include but is not limited to performance milestones and deliverables, <br />payment of fees, and a project development status. This provision maintains flexibility for the City <br />to require additional information as determined necessary over the term of the Agreement. <br />11 A-4 <br />
