Santa Ana City Council <br />December 17, 2019 <br />Page 2 <br />• Conducted first reading of an ordinance approving <br />Development Agreement No. 2018-01, as amended; <br />• Adopted a resolution approving General Plan <br />Amendment No. 2018-06; and <br />• Conducted first reading of an ordinance approving <br />Amendment Application No. 2018-10 for Specific <br />Development No. 93. <br />(Ntc. of Determination, at p. 2.) <br />Petitioner's action will challenge the project commonly referred to as "Magnolia at the <br />Park" or "the Addington," a proposed multi -family residential development project <br />located at 2525 N. Main Street, Santa Ana, California, and generally at the northeast <br />corner of N. Main Street and Edgewood Road, Santa Ana, California. Petitioner seeks <br />to challenge the project identified in the attached Notice of Determination, titled "2525 N. <br />Main Street Multi -Family Residential Project." (Ntc. of Determination, at p. 2.) <br />This action will seek a peremptory writ of mandate/mandamus to vacate and to set <br />aside the decision of the Santa Ana City Council as outlined in the Notice of <br />Determination attached hereto and quoted above, seeking relief as follows: <br />• To vacate and set aside certification of the inadequate Environmental <br />Impact Report No. 2018-01 (SCH No. 2018021031) ("EIR"); <br />• To vacate and set aside the Notice of Determination for the set aside <br />its filing of the notice of determination for the project titled "2525 N. <br />Main Street Multi -Family Residential Project'; <br />To review the project titled "2525 N. Main Street Multi -Family <br />Residential Project' in entirety; <br />• To recirculate the EIR; <br />• To prepare a legally adequate environmental impact report; and, <br />To otherwise comply with CEQA and all other applicable state, federal, <br />and local laws, regulations, ordinances, and policies in reviewing the <br />project titled "2525 N. Main Street Multi -Family Residential Project." <br />In addition to a peremptory writ of mandate directing the Santa Ana City Council to take <br />action as outlined above, petitioner will also seek <br />• An order staying the effects of the certification of the EIR and other <br />possible approvals; <br />4398.101 / 8550922.1 <br />
