N-2019-276 <br />DEC Y Q 19 LICENSE AND RIGHT OF ENTRY AGREEMENT <br />2� 1316 E. Pomona Street, Santa Anal <br />This License and Right of Entry Agreement is entered into on the date referenced below by the City of <br />Santa Ana, a charter city and municipal corporation duly organized and existing under the Constitution <br />and laws of the State of California ("City"), and Mauricio Rivera Rivas, owner ("Owner") of the real <br />property located at 316 E. Pomona Street, in the City of Santa Ana, County of Orange, APN No. 403- <br />183-04 ("Property"), as depicted on Exhibit A. In consideration of the benefits accruing to Owner under <br />this Agreement, Owner hereby grants to City the right to enter the Property and a license for the <br />following purposes: <br />Construction of improvements, including without limitation sewer lateral slope <br />adjustment, in conjunction with Capital Improvement Project No. 17-6437 for <br />Citywide Sewer Main Improvements <br />City agrees to indemnify and hold harmless Owner from any liability arising out of City's exercise of <br />this License and Right of Entry Agreement. City further agrees to repair any damage to the Property <br />caused by the exercise of this License and Right of Entry at City's sole cost and expense, and to restore <br />the Property, with the exception of the improvements left thereon, as nearly as practicable to the state in <br />which it existed prior to the use of the Property by City. <br />The rights herein granted to the City are exclusive, and the City agrees not to assign, transfer, lease, <br />pledge, or otherwise dispose of its License and Right of Entry without the prior express written approval <br />of Owner.
