REQUEST FOR
SUCCESSOR AGENCY
ACTION (D
MEETING DATE:
FEBRUARY 4, 2020
TITLE:
ADOPT RESOLUTION ESTABLISHING CITY
MANAGER'S CONTRACT AUTHORITY UP
TO $50,000 FOR THE SUCCESSOR AGENCY
{STRATEGIC PLAN NO. 5, 11
/s/Kristine
CITY MANAGER
CLERK OF THE COUNCIL USE ONLY:
@1»CAID0W
❑ As Recommended
❑ As Amended
❑ Implementing Resolution
❑ Other
CONTINUED TO
11►U11:3q;7
RECOMMENDED ACTION
Adopt a resolution establishing the authority of the City Manager to execute contracts in an amount
not to exceed $50,000 for the Successor Agency, thus mirroring the 2019 approved limits of the
City Manager.
DISCUSSION
On November 18, 1986, the former Community Redevelopment Agency of the City of Santa Ana
granted its Executive Director the authority to execute agreements in an amount not to exceed
$10,000, which matched the same authority given to the City Manager. In 2006, the residents
voted to amend Section 421 of the City's Charter to increase the City Manager's authority to
execute agreements up to $25,000 and to require the City Manager to submit quarterly reports on
all such agreements to the City Council at a public meeting. This same increase in contract
authority and reporting requirements was granted to the Executive Director of the former
Community Redevelopment Agency through the approval of Resolution No. CRA 2008-006.
On November 19, 2012, the Successor Agency Board adopted Successor Agency Resolution No.
2012-009 to authorize the City Manager to execute agreements on behalf of the City, acting as the
Successor Agency, in the amount of $25,000. This allowed the Successor Agency to continue to
wind down the affairs of the former redevelopment agency more efficiently.
On March 19, 2019, City Council adopted Ordinance No. NS-2963 to amend certain sections of
the Santa Ana Municipal Code relating to the City Manager's authority to bind the City to non-public
works contracts and increased the amount up to $50,000. In order to maintain consistency
throughout City/Successor Agency operations and to alleviate the need to expend administrative
resources to prepare agenda staff reports for multiple agreements exceeding $25,000 but under
$50,000, staff recommends increasing the City Manager's authority up to the same $50,000 cap
as City agreements. The City Manager shall be required to continue to provide a report each
quarter on the contracts executed.
SA-3-1
