SUCCESSOR AGENCY RESOLUTION NO. 2020-XX <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA ACTING AS SUCCESSOR AGENCY TO THE <br />FORMER COMMUNITY REDEVELOPMENT AGENCY <br />ESTABLISHING AUTHORITY OF THE CITY MANAGER TO <br />EXECUTE SUCESSOR AGENCY CONTRACTS IN AN <br />AMOUNT NOT TO EXCEED $50,000 <br />BE IT RESOLVED BY THE MEMBERS OF THE SUCCESSOR AGENCY OF THE <br />CITY OF SANTA ANA. AS FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana, acting as the Successor <br />Agency, conclusively finds, determinesand declares as follows: <br />A. On January 9, 2012, pursuant to Section 34173 of the California Health & <br />Safety Code, the City of Santa Ana ("City") elected to serve as the Successor <br />Agency for the former Community Redevelopment Agency ("Agency") of the <br />City of Santa Ana. <br />B. The City will perform its functions as the Successor Agency under the <br />Dissolution Act to administer the enforceable obligations of the Agency and <br />otherwise unwind the Agency's affairs. In order to unwind the Agency's affairs, <br />the Successor Agency will need to have contract authority similar to that of the <br />City. <br />C. In November of 2006, the residents of the City of Santa Ana voted to amend <br />Section 421 of the City's Charter to increase the City Manager's authority to <br />execute agreements, and further provide that the City Manager must submit <br />quarterly reports to the City Council at a public meeting reporting on all such <br />agreements. <br />D. On March 19, 2019, the City Council of the City of Santa Ana adopted <br />Ordinance No. NS-2963 increasing the City Manager's authority for non-public <br />works contracts in an amount not to exceed $50,000, after determining that <br />doing so will free staff time from the administrative burden of bringing numerous <br />contracts to the City Council for approval and allow staff to devote time to the <br />efficient and timely delivery of services to the public. <br />E. Regardless of the contract amount, all contracts must comply with the City's <br />Purchasing Policies & Procedures designed to ensure fair and competitive <br />procurement practices. <br />F. At this time, it is appropriate for the City, acting as the Successor Agency, to <br />be granted the same contract authority for consistency. <br />Resolution No. 2020-XX <br />SA-3-3 Page 1 of 3 <br />
