EXHIBIT A <br />Resolution No. _____ Page 10 of 76 <br />Certification of the Magnolia at the Park EIR <br />6.0 ENVIRONMENTAL REVIEW AND PUBLIC PARTICIPATION <br />In conformance with CEQA and the CEQA Guidelines, the City conducted an extensive environmental <br />review of the Project. <br />• The City circulated a Notice of Preparation (NOP) and Initial Study for a 30-day public review <br />period, which commenced on February 12, 2018, and ended on March 13, 2018. The NOP was <br />distributed to all public agencies, trustee agencies, and the State Office of Planning and Research; <br />posted in the OC Register, posted at the Orange County Clerk-Recorder’s office and on the City’s <br />website; and provided for public review at the Santa Ana Public Library and at the City’s Planning <br />Division counter. <br />• Based on the Initial Study and Environmental Check List Form (CEQA Guidelines Appendix G), <br />the City staff determined that an EIR should be prepared for the Project. A scoping meeting was <br />held during the NOP review period to allow public agencies, local residents, and interested persons <br />an opportunity to review the Project and provide input on issues to be addressed in the EIR. The <br />scoping meeting was held on March 1, 2018 from 5:30 to 7:30 p.m. at the First Congressional <br />Church of Santa Ana, located at 2555 Santiago Street. Notice of the scoping meeting was sent to <br />state and local agencies, cities, individuals who expressed interest in the Project and notice of the <br />meeting was also included in the Notice of Preparation. <br />• The scope of the DEIR was determined based on the City’s Initial Study, comments received in <br />response to the NOP, and comments received at the scoping meeting conducted by the City. <br />Section 2.4, Areas of Controversy of the DEIR summarizes the issues identified for analysis. <br />• The DEIR was originally made available for a 45-day public review period from August 7, 2018 <br />to September 20, 2018. The public review period was then extended to 59-days (an additional 2 <br />weeks to October 4, 2018) in response to a request from the public. The Notice of Completion was <br />sent to all interested persons, agencies, cities and organizations and notice posted at the Orange <br />County Clerk-Recorder’s office and in the OC Register. The Notice of Completion was also sent <br />to the State Clearinghouse for distribution to additional public agencies. Copies of the DEIR were <br />made available on the City’s website at: http://santa- <br />ana.org/pba/planning/2525mainresidentialdevelopment.asp, and at the following locations: <br />o City of Santa Ana, Planning Division Counter, 20 Civic Center Plaza, M-20, Santa Ana, CA <br />92701 <br />o City of Santa Ana Public Library, 26 Civic Center Plaza, Santa Ana, CA 92701 <br />• On August 27, 2018, the Planning Commission held a duly noticed public hearing to receive <br />comments on the Draft Environmental Impact Report. Notice of the meeting was posted in the OC <br />Register and mailed to property owner and occupants within 500 feet. <br />• On November 15, 2018, the City released the Final EIR which consists of the Draft EIR, all <br />technical appendices prepared in support of the Draft EIR, all written comment letters received on <br />the Draft EIR, written responses to all written comment letters received, revisions to the Draft EIR <br />and technical appendices, and the Mitigation Monitoring and Reporting Program. <br />• On November 26, 2018, the Planning Commission continued the public hearing for the project to <br />January 14, 2019. <br />• On January 14, 2019, the Planning Commission conducted a duly noticed public hearing to <br />consider the EIR, Development Agreement No. 2018-01, General Plan Amendment No. 2018-06, <br />and Amendment Application No. 2018-10 and solicit further comments on the EIR. After hearing <br />all relevant testimony from staff, the public and the City’s consultant team, the Planning <br />Commission voted to recommend that the City Council not certify the EIR, adopt the findings, the <br />2-40
