1.1 <br />1.2 <br />1.3 <br />1.4 <br />ARTICLE 1 <br />DEFINITIONS <br />Whenever any term used in this Agreement has been defined by the provisions of <br />Chapter 16, Article II, Section16.29 of the Santa Ana Municipal Code or by Division 30, <br />Part 1, Chapter 2 of the California Public Resources Code, the definitions in the <br />Municipal Code or the Public Resources Code shall apply unless the term is otherwise <br />defined in this Agreement, in which case this Agreement shall control. <br />Except as provided in Article 1, words beginning with lower case letters are being used <br />with their common ordinary meanings, not as defined terms. Otherwise, the following <br />capitalized words and terms used in this Agreement shall have the following respective <br />meanings: <br />AB 1594 <br />"AB 1594" means that per California Public Resources Code Section 41781.3 et seq., <br />commencing January 1, 2020, the use of green material as landfill alternative daily cover <br />does not constitute diversion through recycling and shall be considered disposal. <br />"AB 1826" means the Organic Waste Recycling Act of 2014 (Chapter 727, Statutes of <br />2014 modifying Division 30 of the California Public Resources Code), also commonly <br />referred to as "AB 1826, ' as amended, supplemented, superseded, and replaced from <br />time to time. <br />AB 341 <br />"AB 341" means the California Jobs and Recycling Act of 2011 (Chapter 476, Statutes of <br />2011 [Chesbro, AB 341]), also commonly referred to as "AB 341," as it may be amended <br />supplemented, superseded, or replaced from time to time. <br />::• <br />"AB 939" means the California Integrated Waste Management Act of 1989 (California <br />Public Resources Code Section 40000 et seg.), as it may be amended, supplemented, <br />superseded, or replaced from time to time. <br />February 11, 2020 6 8412 5 City of Santa Ana - DRAFT <br />
