The documents related to the Initial Study and Mitigated Negative <br />Declaration were made available for a 20-day public review and comment <br />period between January 6, 2020 and January 26, 2020 at Santa Ana City <br />Hall, the Main Library, and on the project webpage on the City's website. <br />G. Comments received were addressed in a Response to Comments <br />document that provides sufficient information to demonstrate that the <br />environmental conclusions and mitigation measures remain valid as <br />disclosed in the Mitigated Negative Declaration. <br />H. The mitigation measures set forth in the Mitigated Negative Declaration are <br />fully enforceable and will be implemented using the Mitigation Monitoring <br />and Reporting Program attached hereto as Exhibit A, and incorporated <br />herein by reference. <br />On January 27, 2020, the Planning Commission of the City of Santa Ana <br />held a duly noticed public hearing. During its deliberations, the Planning <br />Commission considered the environmental analysis and mitigation <br />measures described in the draft Mitigated Negative Declaration <br />Environmental Review No. 2018-28 and voted 6:0:1 (Rivera absent) to <br />continue the item to the February 10, 2020 Planning Commission meeting <br />in order to provide the Commission additional information pertaining to <br />vehicle circulation, perimeter fencing, landscaping and lighting. <br />J. On February 10, 2020, the Planning Commission of the City of Santa Ana <br />held a duly noticed public hearing. During its deliberations, the Planning <br />Commission considered the environmental analysis and mitigation <br />measures described in the draft Mitigated Negative Declaration <br />Environmental Review No. 2018-28 and recommended that the City Council <br />adopt a resolution approving Amendment Application No. 2019-03, <br />Conditional Use Permit 2019-01, and adopt Mitigated Negative Declaration <br />(MND), Environmental Review No. 2018-28 and the Mitigation Monitoring <br />and Reporting Program. <br />K. On March 17, 2020, the City Council of the City of Santa Ana held a duly - <br />noticed public hearing to consider all testimony, written and oral, related to <br />Initial Study and Mitigated Negative Declaration, Environmental Review No. <br />2018-28, at which time all persons wishing to testify were heard, the <br />project was fully considered, and all other legal prerequisites to the <br />adoption of this Resolution occurred. <br />Section 2. The City Council has independently reviewed and analyzed the <br />information contained in the Initial Study and the Mitigated Negative Declaration (MND), <br />Environmental Review No. 2018-28, prepared with respect to this project.
