WHEREAS, the City Council of the City of Santa Ana, hereby desires that Contractor be <br />engaged to provide for both the Collection of Solid Waste within the corporate limits of <br />the City of Santa Ana and the transportation of such Solid Waste to appropriate places <br />for processing, Recycling, Organics Diversion, and Disposal, and to perform such <br />services on the terms and conditions set forth in this Agreement; and <br />WHEREAS, Contractor has agreed, as part of this Agreement, acting as an independent <br />contractor to provide such personnel, equipment and supplies as are necessary to <br />ensure City complies with the requirements of Public Resources Code Section 49100 et <br />seq., <br />WHEREAS, Contractor agrees to and acknowledges that it shall arrange for the proper <br />Disposal of all Solid Waste Collected in City and City is not instructing Contractor how <br />to Collect, process and dispose of Solid Waste. <br />NOW, THEREFORE, for the reasons recited above, and in consideration of the respective <br />and mutual covenants and promises hereinafter contained and made, and subject to all <br />the terms and conditions hereof, the parties hereto do hereby agree as follows: <br />March 9, 2020 6UA_92 <br />City of Santa Ana - DRAFT <br />
