jmf 3/26/20 <br />EXHIBIT 1 <br />RESOLUTION NO. 2020-XXX <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA ESTABLISHING A SMALL CELL APPLICATION <br />FEE FOR CITY -OWNED FACILITIES <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines and <br />declares as follows: <br />A. Each year, for the convenience of the public, the City Council gathers in a <br />single document a comprehensive listing of fees and service charges imposed by the City <br />upon those persons seeking services of value from the City. <br />B. This document is known as the Miscellaneous Fees Schedule for Fiscal <br />Year 2019-2020 and is on file at the office of the Clerk of the Council and available on the <br />City's website. <br />C. The City has begun entering into master licensing agreements with wireless <br />carriers and infrastructure providers to allow them to use City -owned street lights for the <br />installation and operation of their small cell antennas and related equipment. These <br />agreements require the payment of an "Application Fee" for each individual site or location <br />proposed to be used. <br />D. Based on the estimated costs to administer and process each application <br />for the use of City -owned facilities for the above purpose, the fee set forth below is <br />recommended. <br />Section 2. Following a duly -noticed public hearing held on April 7, 2020, at <br />which any and all interested persons were heard, the City Council hereby establishes an <br />Application Fee of $1,741.79 for the processing of applications related to the installation <br />of small cell antennas on City -owned street lights. <br />Section 3. Without further action of the City Council, the above -referenced fee <br />established by this Resolution shall be incorporated into the City's Uniform Schedule of <br />Miscellaneous Fees for Fiscal Year 2019-20. <br />Section 4. This Resolution shall take effect immediately upon its adoption by <br />the City Council, and the Clerk of the Council shall attest to and certify the vote adopting <br />this Resolution. <br />Resdution No. 2020-XXX <br />Page 1 of 2 <br />75B-3 <br />
