Krolikowski <br />Chartes.Krolikowskl@ndif.com <br />Honorable Mayor and Members of the City Council of Santa Ana: <br />As you know, this office represents Santa Ana Citizens for Responsible Development <br />("SACRD"), petitioner in the abovementioned matter. <br />As you are aware, SACRD has filed a lawsuit against the City under the California <br />Environmental Quality Act ("CEQA") for its approval of the 2525 N. Main Street Project <br />("Project"). As recently as yesterday April 6, 2020, SACRD filed its First Amended <br />Petition to include the other non-CEQA Project approvals that were reconsidered and <br />decided by the City Council on January 21, 2020. <br />Further, as you may or may not be aware, the Orange County Register of Voters just <br />certified the Referendum Petition to have the Project approvals set aside. <br />The reason these issues are being raised prior to the April 7, 2020 City Council meeting <br />is that SACRD is concerned that the City will allow the developer of the Project to <br />proceed with demolition of the existing structures before the above issues are decided. <br />As you may or may not know, the certification of a referendum petition automatically <br />suspends the Project approvals. (Elections Code, §§ 9237, 9241.)
