Program Specific Terms and Conditions: <br />30. Debarment: <br />Subrecipient shall execute and abide by the Debarment & Suspension Certification, attached <br />hereto as Exhibit 2 and incorporated herein by this reference, and by so doing declares that it is <br />not debarred or suspended or otherwise excluded from or ineligible for participation in <br />Federal/State assistance programs in accordance with 2 C.F.R. et seq. including 2 C.F.R. <br />200.213, 2 C.F.R. 2998. <br />31. Lobbying: <br />A. Subrecipient shall execute and abide by the terms of the "Certification Regarding <br />Lobbying," which is attached hereto as Exhibit 3 and incorporated herein by this <br />reference. Subrecipient shall complete and immediately forward to the County's Project <br />Manager the "Disclosure Form to Report Lobbying," a copy of which is attached hereto <br />as Exhibit 4 and incorporated herein by this reference, I <br />f Subrecipient, or any person, firm or corporation acting on Subrecipient's behalf, <br />engaged or engages in lobbying any federal office, employee, elected official or agency <br />with respect to this Contract or funds to be received by Subrecipient pursuant to this <br />Contract. <br />B. Subrecipient agrees that the funds provided herein shall not be used to promote, directly <br />or indirectly, any political party, political candidate or political activity, except as <br />permitted by law. <br />C. Subrecipient shall be in compliance with the Byrd Anti -Lobbying Amendment (31 U.S.C. <br />1352 and 29 CFR Part 93). <br />32. Fraud: <br />Subrecipient shall immediately report all suspected or known instances and facts concerning <br />possible fraud, abuse or criminal activity under this Contract. Subrecipient shall inform staff and <br />the general public of how to report fraud, waste or abuse through appropriate postings of incident <br />reporting notice. The County's Anti -Fraud Program can be accessed through: <br />http://ocgov.com/gov/risk/programs/antifraud. <br />33. Fiscal Accountability: <br />A. Subrecipient shall establish and maintain a sound financial management system, based <br />upon generally accepted accounting principles. Subrecipient's system shall provide fiscal <br />control and accounting procedures that will include the following: <br />1) Information pertaining to sub -grant and Contract awards, obligations, unobligated <br />balances, assets, expenditures, and income; <br />2) Effective internal controls to safeguard assets and assure their proper use; <br />3) A comparison of actual expenditures with budgeted amounts for each sub grant <br />and Contract; <br />4) Source documentation to support accounting records; and <br />5) Proper charging of costs and cost allocation. <br />County of Orange Page 26 of 42 City of Santa Ana. <br />Orange County Community Resources 20 <br />A -2 Q ContractNo.: 19-28-0070-RWS <br />
