SUPPLANTING GOVERNMENT FUNDS <br />CONTRACTOR shall not supplant any federal, State, or COUNTY funds intended for the <br />purposes of this Agreement with any funds made available under this Agreement. <br />CONTRACTOR shall not claim reimbursement from COUNTY for, or apply sums received from <br />COUNTY with respect to, that portion of its obligations which have been paid by another source <br />of revenue. CONTRACTOR agrees that it shall not use funds received pursuant to this Agreement, <br />either directly or indirectly, as a contribution or compensation for purposes of obtaining federal, <br />State, or COUNTY funds under any federal, State, or COUNTY program without prior written <br />approval of ADMINISTRATOR. <br />18. EQUIPMENT <br />18.1 All items purchased with funds provided under this Agreement, or which are <br />furnished to CONTRACTOR by COUNTY, which have a single unit cost of at least five thousand <br />dollars ($5,000), including sales tax, shall be considered Capital Equipment. Title to all Capital <br />Equipment shall, upon purchase, vest and remain in COUNTY. The use of such items of Capital <br />Equipment is limited to the performance of this Agreement. Upon the termination of this <br />Agreement, CONTRACTOR shall immediately return any items of Capital Equipment to <br />COUNTY or its representatives, or dispose of them in accordance with the directions of <br />ADMINISTRATOR. <br />CONTRACTOR further agrees to the following: <br />18.1.1 To maintain all items of Capital Equipment in good working order and <br />condition, normal wear and tear excepted. <br />18.1.2 To label all items of Capital Equipment, do periodic inventories as required <br />by ADMINISTRATOR, and to maintain an inventory list showing where and how the Capital <br />Equipment is being used, in accordance with procedures developed by ADMINISTRATOR. All <br />such lists shall be submitted to ADMINISTRATOR within ten (10) days of any request therefore. <br />18.1.3 To report in writing to ADMINISTRATOR immediately after discovery, <br />the loss or theft of any items of Capital Equipment. For stolen items, the local law enforcement <br />agency must be contacted and a copy of the police report submitted to ADMINISTRATOR. <br />WGM0319 <br />Pa e 19 of 40 <br />25�-21 <br />3-31-2020 <br />
