ARTICLE IX <br />9.0 OTHER LEAVES OF ABSENCE <br />9.1 Sick Leave <br />A. Definition <br />Except as otherwise provided below, sick leave shall be deemed to mean absence <br />from duty of an employee because of illness, injury, medical, or dental appointment <br />that prevents the employee from performing the duties of his/her position and shall <br />be deemed to include time in quarantine resulting from exposure to a contagious <br />disease. <br />The City provides paid sick leave to eligible employees upon verbal or written <br />request, within the parameters of the law, for the following purposes: <br />Diagnosis, care, or treatment of an existing health condition, or preventative <br />care of an employee or an employee's qualified family member; <br />Specified purposes for an employee who is a victim of domestic violence, <br />sexual assault or stalking. <br />B. Accrual <br />Each employee shall cam six (6) hours of sick leave per month, for a total maximum <br />annual accrual of seventy-two (72) hours per calendar year. <br />C. Use of Sick Leave <br />1. Authorization for Use <br />Use of sick leave shall be authorized as follows: <br />a. Sick leave is not a right which an employee may use at his/her discretion, <br />but shall be allowed only in cases of necessity and actual sickness and <br />disability, as authorized in this article. <br />b. When an accepted industrial illness or injury has caused an employee's <br />absence, for which benefits are required under the State Workers' <br />Compensation Insurance and Safety Act, paid sick leave at the prorated <br />amount based on hours worked will be allowed such employee during the <br />first three ('3) consecutive days of the statutory waiting period. If the <br />employee does not have sufficient accumulated sick leave at the <br />commencement of such industrial illness or injury, they will be advanced <br />2019-2022 MOU City of Santa Ana & SEIU Part -Time Civil Service Employees <br />age 38ov <br />1 <br />20C-41 <br />
