5 May 2020 <br />Dear Mayor Pulido and City Council Member of the City of Santa Ana, <br />The impact of COVID-19 across the globe has been nothing short of devastating. This pandemic has disrupted the social <br />and economic lives of everyone in our country but its impact, however, is not being felt equally across the board. It is now <br />well established that communities of color, particularly brown and black communities, are disproportionately represented <br />in the negative effects of the current health crisis. I am writing to you as a concerned resident of Santa Ana because I see <br />this scenario affecting my neighborhood. <br />I urge you to demonstrate the leadership that the times demand in protecting our city's most vulnerable populations by <br />bolstering the moratorium that was recently enacted by council. The current protections that have been passed statewide <br />and locally are insufficient because landlords can still serve eviction notices for other non-COVID related reasons including: <br />• Nonpayment of rent due to non-COVID related reasons <br />• 30-day notice (not protected by AB 1482) <br />• 60-day notice (AB 1482 protections) <br />• 60-day notice (non AB 1482) <br />• 3-day notices to perform or quit <br />• 90-day notices <br />The lack of comprehensive protections on evictions puts the lives of Santa Ana residents at significant risks in experiencing <br />loss of housing during this pandemic. As elected officials in Santa Ana, you have the unique powerto reducethese negative <br />economic impacts. Simply put, to mitigate the spread of COVID-19, people need homes to "shelter in place" and to follow <br />orders of physical distancing. Stable housing is not possible if our residents are burdened with the precarity the pandemic <br />has highlighted in theirjobs and overall livelihoods. Stable housing is also not possible without ensuring that residents in <br />Santa Ana not only maintain housing during but also afterthis national emergency. We demand you take immediate action <br />to enact a stronger moratorium to protect residents here in Santa Ana: <br />• During the state of emergency, no landlord shall endeavor to evict a tenant in any of the following situations: <br />o Nonpayment of rent <br />o No -Fault Eviction <br />o Eviction based upon alleged breach of covenant of an oral or a written lease or rental agreement 10 <br />o Eviction based upon an incurable breach <br />o Abandonment of the rental unit during the COVID-19 pandemic, or to flee domestic violence or elder <br />abuse that may occurto a tenant during the COVID-19 pandemic. <br />• A moratorium on the issuance and execution of writs of possession and execution while declarations of <br />emergency related to COVID-19 are in effect, and for an appropriate period thereafter. <br />Thank you in advance for your time and consideration.
