above. For purposes of acquiring any investments hereunder, the Trustee may commingle funds <br /> held by it hereunder. The Trustee may act as principal or agent in the acquisition or disposition <br /> of any investment and may impose its customary charges therefor. The Trustee or its affiliates <br /> may act as sponsor, advisor or depository with respect to any Permitted Investment. To the <br /> extent that any Permitted Investment purchased by the Trustee are registrable securities such <br /> Permitted Investment shall be registered in the name of the Trustee. The Trustee shall incur no <br /> liability for losses arising from any investments made pursuant to this Section 5.08. <br /> Section 5.09. Valuation and Disposition of Investments. For the purpose of determining <br /> the amount in any fund or account, all Permitted Investments credited to such fund or account <br /> shall be valued at the Fair Market Value thereof. Investments in funds or accounts (or portions <br /> thereof) that are subject to a yield restriction under applicable provisions of the Code, as shall <br /> be specified by the Authority to the Trustee, and (unless valuation is undertaken at least <br /> annually) investments in the Reserve Account shall be valued at the cost thereof in a manner <br /> specified by the Authority to the Trustee (consisting of the "present value" thereof as defined in <br /> section 148 of the Code). <br /> -25- <br />
