REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />MAY 19, 2020 <br />TITLE <br />AUTHORIZE QUITCLAIM OF SANITARY <br />SEWER AND STORM DRAIN EASEMENT <br />AT 2114 EAST FIRST STREET TO <br />BROOMELL COMMERCIAL PROPERTIES <br />CLERK OF COUNCIL USE ONLY: <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 11' Reading <br />❑ Ordinance on 2ntl Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />/s/ Kristine Ridge FILE NUMBER <br />CITY MANAGER <br />RECOMMENDED ACTION <br />Authorize the City Manager to execute a quitclaim deed relinquishing the City's interest in a sanitary <br />sewer and storm drain easement at 2114 East First Street to Broomell Commercial Properties, <br />L.P., subject to non -substantive changes approved by the City Manager and City Attorney. <br />DISCUSSION <br />The City of Santa Ana has received plans for the construction of a mixed -use development with <br />552 affordable residential units and approximately 10,000 square feet of commercial space on a <br />combined approximately 6.89-acre site located at 2114 East First Street. <br />The City currently has a sanitary sewer and storm drain easement of approximately 96 feet wide <br />by 14 feet long (Exhibit 1) on the western portion of the 2.915 acre -property (Exhibit 2). To <br />accommodate the development, the property owner, Broomell Commercial Properties, L.P. wishes <br />to remove the easement in order for the property title to be clear and allow new development to <br />commence. The applicant is requesting the City quitclaim the easement (Exhibit 3), which <br />effectively relinquishes the City's rights over the private property to allow for the project to proceed. <br />Generally, easements provide access or right -of -entry for specified purposes. In this case, an <br />easement was granted to the City on April 16, 1965 to allow the City to access the private property <br />for sanitary sewer and storm drain maintenance purposes (Exhibit 4). The abandoned facilities will <br />be reconstructed to the west of their current location to accommodate the proposed building <br />structure and a new easement will be granted to provide access to the relocated facilities. <br />STRATEGIC PLAN ALIGNMENT <br />Approval of this item supports the City's efforts to meet Goal #3 - Economic Development, Objective <br /># 2 (create new opportunities for business/job growth and encourage private development through <br />new General Plan and Zoning Ordinance policies) and Goal #5 - Community Health, Livability, <br />Engagement & Sustainability, Objective #3 (facilitate diverse housing opportunities and support <br />efforts to preserve and improve the livability of Santa Ana neighborhoods). <br />30A-1 <br />
