City of Santa Ana Well No.32 Rehabilitation Project <br />Final Initial Study/Mitigated Negative Declaration <br />discovered during construction, and procedures to follow in the event an inadvertent discovery <br />(Inadvertent Discovery Plan) is encountered, including appropriate treatment and respectful <br />behavior of a discovery (e.g., no posting to social media or photographs). If requested, a local <br />tribal representative(s) shall be invited to participate in the environmental training to discuss or <br />provide text from a tribal cultural perspective regarding the cultural resources within the region. <br />CUL 2: Archaeological Monitoring — The implementing agency shall retain a qualified <br />archaeological monitor during ground disturbing activities within native soils (below the fill level) <br />that have the potential to impact significant archaeological resources, as determined by a <br />qualified archaeologist in consultation with the implementing agency, and any local Native <br />American representatives expressing interest in the Project. <br />CUL 3: Inadvertent Discovery of Archaeological Resources During Construction — A qualified <br />archaeologist shall prepare an Inadvertent Discovery Plan for the Project. During Project -level <br />construction, should subsurface archaeological resources be discovered, all activity in the <br />vicinity of the find shall stop and a qualified archaeologist shall be contacted to assess the <br />significance of the find according to CEQA Guidelines Section 15064.5. If any find is determined <br />to be significant, the archaeologist shall determine, in consultation with the implementing <br />agency and any local Native American groups expressing interest, appropriate avoidance <br />measures or other appropriate mitigation. Per CEQA Guidelines Section 15126.4(b)(3), <br />preservation in place shall be the preferred means to avoid impacts to archaeological resources <br />qualifying as historical resources. Methods of avoidance may include, but shall not be limited to, <br />Project re-route or re -design, Project cancellation, or identification of protection measures such <br />as capping or fencing. Consistent with CEQA Guidelines Section 15126.4(b)(3)(C), if it is <br />demonstrated that resources cannot be avoided, the qualified archaeologist shall develop <br />additional treatment measures, such as data recovery or other appropriate measures, in <br />consultation with the implementing agency and any local Native American representatives <br />expressing interest in prehistoric or tribal resources. If an archaeological site does not qualify as <br />an historical resource but meets the criteria for a unique archaeological resource as defined in <br />Section 21083.2, then the site shall be treated in accordance with the provisions of Section <br />21083.2. <br />GEO-1: Inadvertent Discoveries of Paleontological Resources — If the construction staff or <br />others observe previously unidentified paleontological resources during ground disturbing <br />activities, they will halt work within a 200-foot radius of the find(s), delineate the area of the find <br />with flagging tape or rope (may also include dirt spoils from the find area), and immediately <br />notify a qualified paleontologist. Construction will halt within the flagged or roped -off area. The <br />paleontologist will assess the resource as soon as possible and determine appropriate next <br />steps in coordination with the City. Such finds will be formally recorded and evaluated. The <br />resource will be protected from further disturbance or looting pending evaluation. <br />NOISE-1: Construction noise levels shall fluctuate depending on the construction phase, <br />equipment type and duration of use, distance between noise source and sensitive receptor, and <br />the presence or absence of barriers between noise source and receptors. Therefore, the Project <br />applicant should require construction contractors to limit standard construction activities as <br />follows: <br />• Equipment and trucks used for Project construction shall utilize the best available <br />noise control techniques (e.g., improved mufflers, equipment redesign, use of intake <br />silencers, ducts, engine enclosures and acoustically -attenuating shields or shrouds, <br />wherever feasible). <br />• Stationary noise sources shall be located as far from adjacent receptors as possible <br />and shall be muffled and enclosed within temporary sheds, incorporate insulation <br />barriers or other measures to the extent feasible. <br />December 2019 78A4-52 Q <br />
