City of Santa Ana Well No.32 Rehabilitation Project <br />Final Initial Study/Mitigated Negative Declaration <br />2.0 RESPONSE TO COMMENTS <br />2.1 OVERVIEW <br />During this public review period a total of one comment letter was received. None of the <br />comments received during the comment period provide any basis to identify any new significant <br />impacts or "significant new information' that would require recirculation of the IS/MND or <br />preparation of an Environmental Impact Report. <br />Although a lead agency is not required to provide written responses to comments on negative <br />declarations or MNDs under the CEQA, the City of Santa Ana Well No.32 Rehabilitation Project <br />has evaluated the comments received on the Well No. 32 Rehabilitation Project IS/MND, and <br />has elected to provide response to comments, as well as clarifications to the IS/MND. <br />2.2 LIST OF COMMENTERS <br />The following representative of an organization submitted written comments on the draft <br />IS/MND: <br />1. Richard Vuong, Manager, Planning Division, OC Public Works Service Area/OC <br />Development Services <br />2.3 COMMENTS AND RESPONSE TO COMMENT <br />This section excerpts those comments received that specifically pertain to the scope and <br />content of the draft IS/MND. A copy of the comment letter is included in Appendix A. <br />2.3.1 Comment Letter No. 1 <br />Richard Vuong, Manager, Planning Division, OC Public Works Service Area/OC <br />Development Services <br />Comment 1-1 <br />As stated in the Draft Initial Study/Mitigated Negative Declaration, the proposed 12" water <br />pipeline will cross over the Santiago Creek Channel (OCFCD Facility No. E08). Please be <br />advised that any work that occurs in or upon the OCFCD right-of-way or flood control facilities <br />shall be conducted so as not to adversely impact channel's structural integrity, hydrology, <br />hydraulic flow conditions, access, maintainability and future channel improvements. <br />Response to Comment 1-1 <br />The proposed Project will not directly involve the Orange County Flood Control District [OCFCD] <br />flood control facilities. The proposed Project Pipeline will cross over Santiago Creek Channel <br />(OCFCD Facility No. E08) within a bay opening beneath the Bristol Street Bridge (replacing an <br />existing pipeline of the same size) and will not adversely impact channel's structural integrity, <br />hydrology, hydraulic flow conditions, access, maintainability and future channel improvements. <br />Comment 1-2 <br />Furthermore, all proposed projects within OCFCD right-of-way should be reviewed and <br />approved by OC Public Works where the work would be conducted only after an encroachment <br />permit has been obtained. For information regarding the permit application process and other <br />details, please refer to the Encroachment Permits Section link on the OC Public Works <br />website: htti)://www.ocpublicworks.com/ds/permits/encroachment permits.
