REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />JUNE 2, 2020 <br />TITLE: <br />RE <br />ADOPT A RESOLUTION DECLARING THE <br />MAY 19, 2020 SPECIAL MUNICIPAL <br />RECALL ELECTION RESULT - WARD 6 <br />ELECTED OFFICER <br />CLERK OF COUNCIL USE ONLY: <br />UT00062wo, <br />❑ <br />As Recommended <br />❑ <br />As Amended <br />❑ <br />Ordinance on 111 Reading <br />❑ <br />Ordinance on 2ntl Reading <br />❑ <br />Implementing Resolution <br />❑ <br />Set Public Hearing For <br />CONTINUED TO <br />/s/ Kristine Ridge FILE NUMBER <br />CITY MANAGER <br />RECOMMENDED ACTION <br />Adopt a resolution declaring the results of the Special Municipal Recall Election held in the City of <br />Santa Ana on May 19, 2020. <br />DISCUSSION <br />A Special Municipal Recall Election was held on May 19, 2020 for the purpose of submitting to the <br />voters of the City the question whether Councilmember Iglesias shall be recalled; and to select <br />successors should the officer be recalled. The results of the election were certified on May 27, <br />2020 by the County of Orange Registrar of Voters (ROV). <br />Pursuant to California Elections Code Sections 10263 and 10264, the City Council must adopt a <br />resolution reciting the fact of the election results as follow: (a) The whole number of votes cast in <br />the city; (b) The names of the persons voted for; (c) the measures voted upon (d) For what office <br />each person was voted for; (e) the number of votes given at each precinct to each person and for <br />or against each measure; and (f) the number of votes given in the city to each person and for and <br />against each measure. <br />Pursuant to Elections Code Sections 11384 and 11385, if the majority of the voters vote in favor of <br />the recall, the officer sought to be recalled shall be removed. The candidate receiving the highest <br />number of votes for the office shall be declared elected for the unexpired term of the recalled officer. <br />The accompanying Resolution and Certificate of Voters to Result of the Canvass of the Special <br />Municipal Recall Election returns identify the results of the balloting. By adopting the resolution, <br />the City Council declares and determine that as a result of the election, a majority of the voters <br />voted to recall Cecilia Iglesias and that Nelida Mendoza is elected to the office of Councilmember <br />for Ward 6 of the City of Santa Ana for the remainder of the previous four-year term ending in 2022. <br />55A-1 <br />
