RESOLUTION NO. 2020-043 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA RECITING THE FACT OF THE SPECIAL <br />MUNICIPAL RECALL ELECTION HELD ON MAY 19, 2020 <br />DECLARING THE RESULTS AND SUCH OTHER <br />MATTERS AS PROVIDED BY LAW <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. A Special Municipal Recall Election was held in the City of Santa Ana on May <br />19, 2020, to propose the question to the voters whether to remove Cecilia <br />Iglesias from office. If a majority of the voters voted in favor of the recall, the <br />candidate receiving the highest number of votes would be elected to fill the <br />remainder of the term, for City Councilmember for Ward 6 which began in <br />2018. <br />B. Pursuant to Elections Code section 10264, the results of the said election, <br />including the whole number of vote -by -mail votes cast in the City, the names <br />of the persons voted for, the measures voted upon, for what office each <br />person was voted for, and the number of votes given in the City to each <br />person and for and against each measure, are set forth in the Certificate of <br />Registrar of Voters to Result of the Canvass of the Special Municipal Recall <br />returns attached hereto as Exhibit A and incorporated herein by this reference <br />as though fully set forth. <br />C. City Charter Section 406 provides that "[t]he City Council shall be the judge of <br />the election and qualifications of its members as defined in section 401 of this <br />charter and shall meet on the first regularly scheduled meeting after election <br />returns are certified for any municipal election at which members of the City <br />Council are elected, declare the results thereof, and install elected members, <br />if any." <br />D. The City Council does declare and determine that, as a result of the election, <br />a majority of the voters voting on the measure relating to the recall of Cecilia <br />Iglesias voted in favor thereof, and that Cecilia Iglesias was recalled from the <br />office of City Councilmember for Ward 6. The City Council determines in <br />accordance with Section 406 of the City Charter that Nelida Mendoza <br />received the highest number of votes and is elected to hold the office of <br />Councilmember for Ward 6. The City Council also declares Nelida Mendoza <br />elected to the office of Councilmember for Ward 6 of the City of Santa Ana for <br />Resolution No. 2020-043 <br />Page 1 of 3 <br />
