INSURANCE ON FILE A-2020-099 <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />0210liIo7o <br />CLERK OF COUNCIL DATE: CONSULTANT AGREEMENT <br />LAG`` �Ov c� �lovs �J INCORPORATING COMMUNITY DEVELOPMENT <br />BLOCK GRANT REQUIREMENTS <br />N THIS AGREEMENT, made and entered into this I" day of July, 2020, by and between <br />N MDG Associates, -Inc., a California corporation ("Consultant"), and the City of Santa Ana, a <br />co charter city and municipal corporation organized and existing under the Constitution and laws of <br />o the State of California ("City"). <br />RECITALS <br />A. The City desires to retain a consultant having special skill and knowledge in the field of <br />grant monitoring and technical support services, as well as administrative services, for <br />federal grant programs, including the Community Development Block Grant <br />("CDBG"), HOME Investment Partnership Program (HOME), Emergency Solutions <br />Grant ("ESG"), and Workforce Innovation Opportunity Act ("WIOA"). <br />B, The City, as an entitlement recipient and grantee of the United States Department of <br />Housing and Urban Development ("HUD") CDBG Program, desires to enter this <br />Agreement with the Consultant for the expenditure of CDBG funds in accordance <br />with Title 24, Part 570 of Code of Federal Regulations 24 CFR 570.000, et seq. <br />("CDBG Regs"). <br />C. Consultant represents that Consultant is not listed as debarred, is able and willing to <br />provide such services to the City, and will comply with the CDBG Regs. <br />D. In undertaking the performance of this Agreement, Consultant represents that it is <br />knowledgeable in its field and that any services performed by Consultant under this <br />Agreement will be performed in compliance with such standards as may reasonably be <br />expected from a professional consulting firm in the field. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />1. SCOPE OF SERVICES <br />Pursuant to this Agreement, Consultant will provide select monitoring and technical support <br />services, as well as administrative services, for the City of Santa Ana's CDBG, HOME, ESG, and <br />WIOA Programs, as set forth in Exhibit A attached hereto and incorporated herein. <br />2. COMPENSATION <br />a. City agrees to pay, and Consultant agrees to accept as total payment for its <br />services, the rates and charges identified in Exhibit A. For monitoring services, <br />the total sum to be expended under this Agreement shall not exceed $38,372.00 <br />
