Natural Environment Study (Minimal Impacts) <br />Day- and night -roosting habitats for several special -status bat species are present <br />within the Fairview Street bridge over the Santa Ana River. Although no bats were <br />observed day roosting within the structure during the daytime habitat assessment, <br />roosting activity was confirmed by the presence of guano beneath the hinge crevices. <br />Because the bat habitat suitability assessment was performed outside of the bat <br />maternity season, and given the suitability of the crevice habitat observed at this <br />structure for maternity roosting, a follow-up nighttime survey will need to be <br />performed at this location during the summer months (i.e., June —August) in order to <br />confirm whether this structure serves as a maternity roost and to determine the <br />numbers and species of any bats roosting there. No additional studies are required for <br />the Project. <br />4. Results: Biological Resources, Discussion of <br />Impacts and Mitigation <br />4.1. Habitats and Natural Communities of Special Concern <br />Habitats are considered to be of special concern based on: (1) federal, State, and/or <br />local laws regulating their development; (2) limited distributions; and/or (3) the <br />habitat requirements of special -status plants or animals. <br />There are no habitats or natural communities of concern within or immediately <br />adjacent to the BSA. The BSA is composed entirely of developed areas, with some <br />ornamental and weedy vegetation. The BSA has low biological value to native plant <br />and wildlife species. <br />4.1.1. Discussion of Jurisdictional Waters <br />Section 404 of the CWA and Section 1602 of the California Fish and Game Code <br />regulate activities affecting resources under the jurisdiction of the USACE and the <br />CDFW, respectively. "Waters of the U.S." under the jurisdiction of the USACE <br />include navigable coastal and inland waters, lakes, rivers, and streams and their <br />tributaries; interstate waters and their tributaries; wetlands adjacent to such waters; <br />intermittent streams; and other waters that could affect interstate commerce. <br />The BSA contains one jurisdictional drainage feature (the Santa Ana River), as <br />discussed in further detail in the corresponding Jurisdictional Delineation Report <br />(Appendix D). <br />................................................................................................................................................ . <br />32 Fairview Street Improvements from 9th Street to 16th Street and Bridge Replacement Project <br />
