SECOND AMENDMENT TO LEGAL COUNSEL SERVICES AGREEMENT WITH CARPENTER, ROTHANS & DUMONT, LLP THIS SECOND AMENDMENT TO AGREEMENT is entered into on this 7" day of July 2020, by and between Carpenter, Rothans & Dumont ("Attorneys"), and the City of Santa Ana, a charter city and municipal corporation duly organized and existing under the Constitution and laws of the State of California ("City"). RECITALS A. The parties entered into Agreement #A-2017-070 dated April 18, 2017 ("Agreement") by which Attorneys agreed to provide City with legal services for a three (3) year term through April 17, 2020. B. On September 3, 2019, the parties entered into a Fast Amendment (A-2019-148) to increase the hourly rate from $200/hour to $225/hour. C. On March 18, 2020, the parties opted to extend the term until April 18, 2021, per the terms of the Agreement. The Agreement is current and in effect. D. The parties now wish to amend the Agreement to extend the term until June 30, 2021. Now, therefore, in consideration of the mutual and respective promises, and subject to the terms and conditions of said Agreement, except as herein modified, the parties agree as follows: THE PARTIES THEREFORE AGREE: 1. Section 6, TERM, shall be amended to extend the term of the Agreement from April 18, 2021 until June 30, 2021. Except as hereinabove modified, the terms and conditions of said Agreement, as amended, remain unchanged and in full force and effect. IN VaINESS WIIEREOF, the parties hereto have executed this Second Amendment to the Agreement the date and year first above written.
