Zoning Ordinance Amendment No. 2020-03 <br />August 3, 2020 <br />Page 3 <br />incentive will be in place until April 2021, with any development not obtaining a building <br />permit by that time obligated to pay the higher rate. Projects subject to a development <br />agreement or an agreement to pay a specific in -lieu fee will be required to comply with the <br />agreement as approved and will not be modified by the proposed ordinance. <br />• Inclusionary Housing Development Incentives — This section is proposed to eliminate <br />the "double" density bonus concession available for developers as part of the production of <br />affordable units while incentivizing developments of for -sale units. The proposed changes <br />will also allow a developer of for -sale, moderate income housing units to request three <br />concessions from the City. The amendment also requires the developer to provide a <br />community benefit as part of the project, which may include park improvements, a <br />community garden, developer funded down payment assistance, or pay a subsidy toward <br />services, activities or programs. <br />Inclusionary Housing Fund — This section is proposed to be revised to clarify the use of <br />in -lieu fees paid to the City. It provides the Community Development Agency with a <br />priority for the use of the funds and allows the funds to be used for one-time programs for <br />code enforcement, and quality of life and general health and safety activities. It also <br />codifies the City's local preference for projects that are funded with in -lieu fees and <br />encourages a commitment to use a skilled and trained workforce to complete the project. <br />CEQA Analysis <br />In accordance with the California Environmental Quality Act, the proposed project is exempt from <br />further review pursuant to Section 15061 (b)(3), as there is no potential for causing a significant <br />impact on the environment due to the adoption of the ordinance.
