WHEREAS, the Project Site is located at the southwest corner of Redhill and Warner Avenue, at a gateway intersection into the City of Santa Ana and a location across major mixed -use development planning areas in the cities of Tustin and Irvine; and WHEREAS, pursuant to Section 21067 of the Public Resources Code, and Section 15367 of the State CEQA Guidelines (California Code of Regulations, Title 14, § 15000 et seq.), the City of Santa Ana is the lead agency for the proposed Project; and WHEREAS, in accordance with State CEQA Guidelines Section 15063(a), the City as Lead Agency determined that an EIR was clearly required for the project, and therefore did not prepare an Initial Study; and WHEREAS, the City determined that an EIR should be prepared to evaluate the proposed Project's potential to have a significant effect on the environment in all of the following areas as required by Appendix G of the CEQA Guidelines Appendices: Aesthetics; Air Quality; Cultural Resources; Energy; Geology and Soils; Greenhouse Gas Emissions; Hazardous Materials; Hydrology and Water Quality; Land Use and Planning; Noise; Population and Housing; Public Services and Recreation; Transportation; Tribal Cultural Resources; Utilities and Service Systems; and Project Alternatives; and WHEREAS, in accordance with State CEQA Guidelines Section 15082, on July 26, 2019, the City sent to the Office of Planning and Research and each responsible and trustee agency a Notice of Preparation ("NOP") - which was also published in the Orange County Register, a newspaper of general circulation - stating that an Environmental Impact Report (SCH No. 2019080011) would be prepared; and WHEREAS, pursuant to Public Resources Code Section 21083.9 and State CEQA Guidelines Sections 15082(c) and 15083, the City held a duly noticed Scoping Meeting on August 15, 2019, to solicit comments on the scope of the environmental review of the proposed Project; and WHEREAS, ten (10) comment letters were received in response to the NOP; and WHEREAS, a Draft Environmental Impact Report ("Draft EIR") was prepared for the proposed Project, addressing comments received in response to the NOP and evaluating the proposed Project's potentially significant environmental impacts; and WHEREAS, the Draft EIR identifies five significant and unavoidable impact associated with this project, which pertain to Air Quality, Greenhouse Gas Emissions, and Transportation. Air Quality impacts stem from emissions from operation of the project exceeding SCAQMD's threshold for volatile organic compounds (VOCs) that would be derived from consumer products and vehicular activity that neither the Applicant nor the City have the ability to reduce. Greenhouse Gas Emissions impacts stem from approximately 60 percent of the GHG emissions being generated by vehicle trips. Neither the Applicant nor the City can substantively or materially reduce the vehicular -source GHG emissions. Lastly, Transportation impacts stem from the Resolution No. 2020-xx 75C-412 Page 2
