DocuSign Envelope ID: EF4B7707-6A52-4917-BE8B-C9000EAD9571 <br />TUSTIN <br />Community Development Department <br />May 21, 2020 <br />Mr. Minh Thai <br />Executive Director <br />City of Santa Ana <br />Planning and Building Agency <br />PO BOX 1988 (M-20) <br />Santa Ana, CA 92702 <br />BUILDING OUR FUTURE <br />HONORING OUR PAST <br />SUBJECT: FINAL ENVIRONMENTAL IMPACT REPORT AND RESPONSES TO COMMENTS FOR THE BOWERY <br />MIXED -USE PROJECT IN THE CITY OF SANTA ANA <br />Dear Mr. Thai: <br />Thank you for this opportunity to relay our significant ongoing concerns regarding the potential impacts to the City <br />of Tustin from The Bowery Mixed -Use Project proposed at the southwesterly corner of Red Hill Avenue and Warner <br />Avenue, which is directly adjacent to the City of Tustin and the Tustin Legacy master planned community. <br />The proposed project consists of the development of a 14.58-acre site with 1,150 multiple family residences within <br />five -story to six -story buildings, wrapped parking structures, and 80,000 square feet of retail and restaurant <br />commercial space. Also proposed is approximately 174,555 square feet of open space within courtyards, common <br />areas, roof decks, perimeter plazas, and other open space areas. The project requires a proposed General Plan <br />Amendment from Professional and Administrative Office to a mixed -use designation and a Zone Change from Light <br />Industrial to Specific Development. <br />In a letter dated February 5, 2020 (Attachment A), the City of Tustin provided comments to the City of Santa Ana on <br />the Draft Environmental Impact Report (DEIR) forthe Bowery Mixed -Use Project. On April 27, 2020, the City of Santa <br />Ana released the Final EIR and Responses to Comments on the DEIR for the Project, which was received by the City <br />of Tustin Community Development Department on May 7, 2020. In response to our request for a continuance and <br />to the concerns raised by others, the Santa Ana Planning Commission continued the hearingto May 26, 2020. <br />City of Tustin staff has reviewed the Final EIR and the responses to our comments contained therein (Attachment B), <br />and believe that none of the City's significant comments or concerns regarding traffic, cumulative impacts, or impacts <br />to Tustin parks that were identified in the February 5, 2020 letter has been adequately addressed or mitigated in the <br />FEIR.
