ER No. 2017-161, GPA No. 2020-03 & TTM No. 2020-01 <br />September 1, 2020 <br />Page 3 <br />uses as a buffer between single-family dwellings and to focus higher intensity uses and <br />developments along arterial roadways, such as nearby Harbor Boulevard. <br />Tentative Tract Map <br />The applicant is seeking approval of a tentative parcel map to subdivide the property into 10 <br />condominium units and one common area lot. In reviewing the project, staff determined that the <br />proposal as conditioned is consistent with the various provisions of the Santa Ana Municipal <br />Code (SAMC) and General Plan, including lot size, lot frontage, and lot coverage. No adverse <br />environmental impacts to fish or wildlife populations were identified as the project site is located <br />in a built -out, urbanized area. In addition, conditions of approval are included requiring the <br />applicant to enter into a property maintenance agreement and to submit the Covenant, <br />Conditions, and Restrictions (CC&Rs) to the Planning Division for review. The CC&Rs will <br />ensure long-term maintenance of the landscaping, parking, buildings, and common amenities. <br />Finally, the tentative map is consistent with the California Subdivision Map Act and Chapters 34 <br />and 41 of the Municipal Code. <br />California Environmental Quality Act (CEQA) <br />Pursuant to CEQA, a MND (Environmental Review No. 2017-161) with technical studies was <br />prepared for the project. No areas of significance were identified from the construction or operation <br />of the proposed project. The project requires adoption of a MMRP, which contains mitigation <br />measures to address biological resources, geology and soils, noise, tribal cultural resources, and <br />cultural resources. On May 6, 2020, the draft MND was circulated to interested parties and the <br />notice of intent (NOI) was published in the Orange County Register and posted with the State's <br />Clearinghouse. The draft MND was available for public review at the City Hall and on the project's <br />webpage on the City's website. All comments received by interested parties were included in the <br />final document. <br />CONCLUSION <br />Based on the analysis provided within this report, staff recommends that the City Council adopt <br />a resolution adopting the prepared MND and MMRP, ER No. 2017-161; a resolution approving <br />GPA No. 2020-03; and a resolution approving TTM No. 2020-01 as conditioned. <br />FISCAL IMPACT <br />There is no fiscal impact associated with approval of this action. <br />Submitted By: Minh Thai, Executive Director — Planning and Building Agency <br />Exhibits: 1.
