uVSMANCE NOT REOUIRE'D <br />o lh'ORK NIAY PROCEED <br />N CLERK 01 COUNCIi. <br />A-2020-133 <br />N <br />SECOND AMENDMENT TO LEGAL COUNSEL SERVICES <br />AGREEMENT WITH CARPENTER, ROTHANS & DUMONT, LLP <br />0 1`Yrtyid Q�n✓11-tnv�n, `� <br />fl ( i) THIS SECOND AMENDMENT TO AGREEMENT is entered into on this 7' day of July 2020, <br />by and between Carpenter, Rothans & Dumont ("Attorneys"), and the City of Santa Ana, a charter city <br />and municipal corporation duly organized and existing under the Constitution and laws of the State of <br />California ("City"). <br />RECITALS <br />A. The parties entered into Agreement #A-2017-070 dated April 18, 2017 ("Agreement") by which <br />Attorneys agreed to provide City with legal services for a three (3) year term through April 17, <br />2020. <br />B. On September 3, 2019, the parties entered into a First Amendment (A-2019-148) to increase the <br />hourly rate from $200/hour to $225/hour. <br />C. On March 18, 2020, the parties opted to extend the term until April 18, 2021, per the terns of the <br />Agreement. The Agreement is current and in effect. <br />D. The parties now wish to amend the Agreement to extend the term until June 30, 2021. <br />Now, therefore, in consideration of the mutual and respective promises, and subject to the terms and <br />conditions of said Agreement, except as herein modified, the parties agree as follows: <br />THE PARTIES <br />AGREE: <br />1. Section 6, TERM, shall be amended to extend the term of the Agreement from April 18, 2021 <br />until June 30, 2021. <br />Except as hereinabove modified, the terms and conditions of said Agreement, as amended, remain <br />unchanged and in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this Second Amendment to the <br />Agreement the date and year first above written. <br />ATTEST: <br />DAISY GOMEZ <br />Clerk of the Council <br />APPROVED AS TO FORM: <br />Sonia R.
