REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />OCTOBER 16, 2020 <br />TITLE: <br />IF STAFF REPORTS THAT THE ORANGE COUNTY AIRPORT <br />LAND USE COMMISSION HAS FOUND THE PROPOSED <br />COMPREHENSIVE UPDATE TO THE GENERAL PLAN IS <br />NOT CONSISTENT WITH THE 2008 AIRPORT ENVIRONS <br />LAND USE PLAN FOR JOHN WAYNE AIRPORT, STAFF <br />RECOMMENDS THAT THE CITY COUNCIL AUTHORIZE THE <br />PLANNING DIVISION TO PROVIDE THE AIRPORT LAND USE <br />COMMISSION AND THE STATE OF CALIFORNIA <br />DEPARTMENT OF TRANSPORTATION DIVISION OF <br />AERONAUTICS A NOTICE OF INTENT OF THE POTENTIAL <br />FOR THE CITY COUNCIL TO OVERRULE THE <br />DETERMINATION OF THE COMMISSION <br />/s/ Kristine Ridge <br />CITY MANAGER <br />CLERK OF COUNCIL USE ONLY: <br />❑ <br />As Recommended <br />❑ <br />As Amended <br />❑ <br />Ordinance on 1"Reading <br />❑ <br />Ordinance on god Reading <br />❑ <br />Implementing Resolution <br />❑ <br />Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />RECOMMENDED ACTION <br />Adopt a resolution authorizing the Planning Division to provide the Orange County Airport Land <br />Use Commission (ALUC) and the State of California Department of Transportation Division of <br />Aeronautics a notice of intent of the potential for the City Council to overrule the determination of <br />the Commission regarding the proposed Comprehensive Update to the General Plan. <br />BACKGROUND AND DISCUSSION <br />The Planning Division is finalizing work on General Plan Amendment No. 2020-06 (GPA No. 2020- <br />06) for the comprehensive update to the City's General Plan. Eleven of the 12 elements of the <br />General Plan have been completed and released for public review. The Housing Element will be <br />separately updated in 2021 awaiting the final housing allocation by the State. Additionally, the draft <br />program environmental impact report (PEIR) for the project has also been released for public review, <br />with the comment period extended by 20 days to October 6, 2020, to provide additional time for the <br />public to provide comments on the document. Since the comprehensive General Plan Update <br />requires a General Plan amendment application, the General Plan Update is required to be referred <br />to the ALUC for a determination of consistency with the Airport Environs Land Use Plan (AELUP) for <br />the John Wayne Airport pursuant to Public Utility Code Section 21676(b). <br />Sections 1.2 and 2.1.4 of the AELUP for John Wayne Airport and Public Utilities Code (PUC) Section <br />21674 empower the ALUC "to assist local agencies in ensuring compatible land uses in the vicinity <br />of existing airports to the extent that the land in the vicinity of those airports is not already devoted to <br />incompatible uses," and "to coordinate planning at the state, regional and local levels so as to provide <br />for the orderly development of air transportation, while at the same time protecting the public health, <br />safety and welfare." <br />However, the input from ALUC is advisory, and as a final review authority on legislative acts, the City <br />Council may, after a public hearing, choose to overrule the ALUC's decision by following the <br />procedure established in PUC Sections 21676 and 21676.5. <br />55A-1 <br />
