Exhibit 1 <br />E. Concessionaire and its employees shall immediately report to City any accident causing <br />property damage or injury to persons in the Concession Area or otherwise related to <br />the Concession use. Such report shall contain the names and addresses of the involved <br />parties, a statement of the circumstances, the date and time of the accident, the names <br />and addresses of any witnesses, and any other pertinent information. <br />F. The City shall have the right to recommend the discharge of any Concession employee <br />for, but not limited to, the following reasons: <br />1) Theft and/or vandalism. <br />2) Sexual harassment. <br />3) Use of abusive or profane language. <br />4) Substance and/or alcohol abuse. <br />5) Any other conduct deemed by the City to be contrary to the best interests of the <br />City. <br />S. CITY'S RIGHTS AND OBLIGATIONS <br />A. The City of Santa Ana will not require a Conditional Use Permit ("CUP") for alcohol <br />sales at the Santa Ana Zoo, 1801 E. Chestnut Ave. Santa Ana, CA 92701. The City <br />will provide written confirmation of Concessionaire's right to sell alcoholic beverages <br />at the zoo and that a CUP is not required for Concessionaire to submit to the ABC. <br />B. The City will maintain the water, natural gas, electrical and sewer lines except in cases <br />where the Concessionaire's direct negligence causes major maintenance repair <br />expense. Should the Concessionaire require additional utility capacity and/or outlets <br />beyond those provided the cost of such installation and hookups will be at the <br />Concessionaire's expense after required City approval. <br />C. City will provide a minimum 90-day notice for any changes to food service operations <br />at the Zoo provided through other agreements. <br />D. The City's Internal Auditor may review the Concessionaire operation periodically to <br />assure compliance with the Agreement between Concessionaire and City. <br />E. Due to special considerations resulting from operations at a Zoo facility, including but <br />not limited to, considerations for Zoo animal safety, special restrictions may be <br />necessary as far as items sold, food packaging, and the location(s) of service. <br />F. The City will pay utilities, which includes water, gas and electricity. <br />G. City may at all times enter and inspect the Concession Area and any temporary or <br />mobile bars. <br />25G-10 <br />
