A-2020-158-34 <br />SANTA ANA CARES FOR LANDLORDS <br />C01) RENTAL ASSISTANCE GRANT AGREEMENT <br />This Rental Assistance Chnt Agreement ClAgreement") is hereby made and entered into this <br />26th day of October, 2020, by and between the City of Santa Ana, a charter city and municipal <br />corporation organized and existing under the Constitution and laws of the State of California <br />("City"), and The Marke at South Coast Metro, LLC, dba The Marke ("Landlord" or "Property <br />Owner"), <br />RECITALS: <br />A, On March 27, 2020, a special allocation of funds was authorized by the Coronavirus Aid, <br />Relief, and Economic Security Act ("CARES Act"), Public Law 116.136, Section 601(a) of <br />the Social Security Act, to prevent, prepare for, and respond to the coronavirus ('COVID- <br />19") pandemic. <br />B. On August 4, 2020, the Santa Ana City Council authorized the City Manager to utilize <br />CARES Act funding for various programs in response to the COVID-19 pandemic, including <br />the Santa Ana CARES for Landlords Rental Assistance Program, which is aimed at assisting <br />tenants within the City of Santa Ana that have been affected by COVID-19 and need <br />assistance in surviving and recovering through this pandemic, <br />C. The CARES for Landlords Rental Assistance Program was established as an emergency <br />response to the COVEDD-19 pandemic to disburse funds to Landlords throughout the City of <br />Santa Ana to provide financial assistance on behalf of their tenants who have been unable to <br />pay their rent as a result of the COVED-19 pandemic (said "Program'), <br />D. Said Program has been structured in such a manner as will ensure that such assistance is <br />determined to be necessary In response to the COVED-19 public health emergency and <br />otherwise satisfies the requirements of the CARES Act and other applicable law, <br />E. Said Program will provide Landlord with financial assistance to cover past duo monthly rent <br />since April 1, 2020, for tenants who have been impacted by COVEDD-19, provided that the <br />Landlord agrees to certain restrictions detailed herein. <br />WHEREFORE, it is agreed by and between the parties that the foregoing Recitals are a <br />substantive part of this Agreement and the following terms and conditions are approved and together <br />with all exhibits hereto, shall constitute the entire Agreement between the City and Landlord: <br />I. PROGRAM PROVISIONS <br />A. Landlord, Landlord is the owner of residential rental property in the City of Santa <br />Ana commonly referred to as: The Marke, and located at: 100 E, MacArthur Blvd.. Santa Ana, <br />Ca" 92707 ("Property"). <br />B. Impacted Tenants, Tenants residing at the Property who have lost jobs, had their work <br />hours reduced, or have experienced a loss of income due to the economic or health impacts of <br />
