<br />The Bowery Mixed-Use Project CEQA Findings of Fact <br /> <br />City of Santa Ana 3 <br />May 2020 <br />SECTION I <br />ENVIRONMENTAL REVIEW AND PUBLIC PARTICIPATION <br />The Final EIR includes the Draft Environmental Impact Report (EIR) dated January 2020, written <br />comments on the Draft EIR that were received during the public review period, written responses to <br />those comments and changes to the Draft EIR, and the Final EIR Errata making minor corrections and <br />revisions to the Final EIR. In conformance with CEQA and the State CEQA Guidelines, the City of <br />Santa Ana conducted an extensive environmental review of the Bowery Mixed-Use Project: <br />• The City of Santa Ana concluded that an EIR should be prepared, and the Notice of <br />Preparation (NOP) was released for a 30-day public review period from July 26, 2019 <br />(Modified on August 5, 2019), through August 29, 2019. The NOP was posted at the <br />Orange County Clerk’s Office on July 26, 2019 and August 5, 2019. The notice was <br />published in the Orange County Reporter, a newspaper of general circulation. Under CEQA, <br />a Lead Agency may proceed directly with preparation of the EIR without preparation of an <br />Initial Study if it is clear that an EIR will be required (State CEQA Guidelines Section <br />15060[d]). The City of Santa Ana has made such a determination for this Project and has <br />not prepared an Initial Study. <br />• Completion of a scoping process, in which the public was invited by the City of Santa Ana <br />to participate. The scoping meeting for the EIR was held on August 15, 2019 at 6:00 p.m. <br />at the Embassy Suites located at 1325 East Dyer Road in Santa Ana. The notice of a public <br />scoping meeting was included in the NOP distributed on July 26, 2019 and August 5, 2019. <br />• Preparation of a Draft EIR by the City of Santa Ana, which was made available for a 46- <br />day public review period (January 3, 2020 through February 18, 2020). The Notice of <br />Availability (NOA) for the Draft EIR was sent to all persons, agencies and organizations on <br />the interest list interested persons, sent to the State Clearinghouse in Sacramento for <br />distribution to public agencies, and published in the January 3, 2020 Orange County <br />Reporter. The NOA was posted at the Orange County Clerk’s Office on January 3, 2020. <br />Copies of the Draft EIR were made available for public review at the City of Santa Ana, <br />Planning Division Counter, located at 20 Civic Center Plaza, M-20, Santa Ana, CA 92701, <br />and the City of Santa Ana Public Library, located at 26 Civic Center Plaza, Santa Ana, CA <br />92701. The Draft EIR was also available for review and download via the following City <br />website location: https://www.santa-ana.org/pb/planning-division/major-planning- <br />projects-and-documents/bowery. <br />• The Final EIR contains comments on the Draft EIR, responses to those comments, revisions to <br />the Draft EIR, if any, and appended documents. The Final EIR was released for a 10-day <br />agency review period prior to certification of the Final EIR. <br />• After considering the EIR and in conjunction with making these findings, the City of Santa <br />Ana hereby finds that pursuant to Section 15092 of the CEQA Guidelines that approval of <br />the Project will result in significant effects on the environment, however, the significant effects <br />will be eliminated or substantially lessened where feasible, and has determined that <br />remaining significant effects are found to be acceptable under Section 15093. <br />• The Mitigation Monitoring and Reporting Program is hereby adopted to ensure <br />implementation of feasible mitigation measures identified in the EIR.
