<br />The Bowery Mixed-Use Project CEQA Findings of Fact <br /> <br />City of Santa Ana 5 <br />May 2020 <br />SECTION II <br />RESOLUTION REGARDING ENVIRONMENTAL IMPACTS NOT REQUIRING MITIGATION <br />Section 15091 of the State CEQA Guidelines does not require specific findings to address <br />environmental effects that an EIR identifies as “less than significant” where no mitigation is required. <br />These findings will nevertheless fully account for all such effects identified in the Draft EIR in this <br />Section II. Thus, the City hereby finds that the following potential environmental impacts of the <br />Project are less than significant and do not require the imposition of mitigation measures: <br />A. Aesthetics <br /> <br />Impact Finding: The Project would not have a substantial adverse effect on a scenic vista (Draft EIR <br />at p. 5.1-23). <br /> <br />Facts in Support of Findings: The Project site and surrounding areas are either urbanized or <br />planned for urbanization and do not contain any sensitive scenic vistas. The General Plan Scenic <br />Corridors Element does not identify any scenic resources or vistas at or adjacent to the Project site. <br />The nearest feature identified by the General Plan is Edinger Avenue, a “Secondary Street <br />Corridor”, which is approximately 1 mile north of the site. Due to the flat topography and distance, <br />Edinger Avenue it is not visible from the Project site. Because there are no scenic vistas within the <br />viewshed of the Project site, no impacts related to the scenic vistas would occur from implementation <br />of the proposed Project. <br /> <br />Impact Finding: The Project would not substantially damage scenic resources, including, trees, rock <br />outcroppings, and historic buildings within a state scenic highway (Draft EIR at p. 5.1-23). <br /> <br />Facts in Support of Findings: There are no officially designated state scenic highways in the vicinity <br />of the proposed Project (Caltrans 2019). The only officially designated scenic highway within <br />Orange County is a portion of SR-91 that is located between SR-55 to east of the Anaheim city <br />limit (Caltrans 2019), which is not in the vicinity of the Project site. Likewise, there are no County- <br />designated scenic highways that run through the City of Santa Ana. Further, the proposed Project <br />site is flat and surrounded by an urban built environment, and there are no other scenic resources, <br />including trees, rock outcroppings, or historic buildings within the viewshed of the Project. Therefore, <br />no impacts related to scenic resources within a state scenic highway would occur. <br /> <br />Impact Finding: The Project would not substantially degrade the existing visual character or quality <br />of public views of the site and its surroundings and would not conflict with applicable zoning and <br />other regulations governing scenic quality (Draft EIR at p. 5.1-24). <br /> <br />Facts in Support of Findings: <br />Construction <br />Construction of the proposed Project is anticipated to last approximately 27-months. Views of <br />demolition and construction activities would exist from adjacent public view locations along Red Hill <br />Avenue and Warner Avenue. During Project demolition and construction, various activities would <br />alter the character of the Project site and its surroundings. Graded surfaces, demolition and <br />construction debris, construction equipment, and truck traffic would be visible. Soil would also be <br />stockpiled and equipment for grading activities would be staged at various locations throughout <br />the site. Construction-related visual impacts would not be constant over the 27-month construction <br />3-27
