<br />The Bowery Mixed-Use Project CEQA Findings of Fact <br /> <br />City of Santa Ana 10 <br />May 2020 <br /> <br />Impact Finding: The Project would not disturb any human remains, including those interred outside <br />of formal cemeteries (Draft EIR at p. 5.3-8). <br /> <br />Facts in Support of Findings: The Project site has been extensively disturbed and has not been <br />previously used as a cemetery. Thus, impacts related to human remains are less than significant. In <br />the unanticipated event that human remains are found during project construction activities <br />compliance with California Health and Safety Code Section 7050.5 would ensure that human <br />remains are treated with dignity and as specified by law. <br /> <br />As specified by California Health and Safety Code Section 7050.5, if human remains are found on <br />the Project site, the County Coroner’s office shall be immediately notified and no further excavation <br />or disturbance of the discovery or any nearby area reasonably suspected to overlie adjacent <br />remains shall occur until the Coroner has made the necessary findings as to origin and disposition <br />pursuant to Public Resources Code 5097.98. If the Coroner recognizes the remains to be Native <br />American, he or she shall contact the Native American Heritage Commission (NAHC) within 24 hours. <br />The NAHC will make a determination as to the Most Likely Descendent. Compliance with the existing <br />California Health and Safety Code regulations, would ensure impacts related to potential <br />disturbance of human remains are less than significant. <br /> <br />D. Energy <br />Impact Finding: The Project would not result in potentially significant environmental impact due to <br />wasteful, inefficient, or unnecessary consumption of energy resources, during project construction or <br />operation (Draft EIR at p. 5.4-5). <br />Facts in Support of Findings: <br />Construction <br />During construction of the proposed Project, energy would be consumed in three general forms, <br />petroleum-based fuels, electricity, and energy used in the production of construction materials. <br />Construction activities related to the proposed mixed-use Project would not be expected to result <br />in demand for fuel greater on a per-unit-of-development basis than other development projects in <br />Southern California. Construction would occur over a 27-month period and the demand for <br />construction-related electricity and fuels would be limited to those time frames. <br />Draft EIR pages 5.4-6 through 5.4-7 detail that construction of the proposed Project is estimated <br />to result in the need for 1,674,604 kWh of electricity, approximately 123,957 gallons of diesel <br />fuel. Construction workers would use approximately 291,025 gallons of fuel to travel to and from <br />the Project area. Approximately 25,976 gallons of fuel would be used by medium high duty and <br />160,174 gallons of fuel would be used for hauling by heavy-duty trucks during construction of the <br />proposed Project. <br />Construction contractors are required to demonstrate compliance with applicable California Air <br />Resources Board (CARB) regulations and compliance with existing CARB idling restrictions and the <br />use of newer engines and equipment would reduce fuel combustion and energy consumption on the <br />Project site. Overall, construction activities would require limited energy consumption and would <br />comply with all existing regulations. Thus, impacts related to construction energy usage would be <br />less than significant. <br /> <br />3-32
