5.0 Environmental Analysis 5.6 Noise <br />Avion Project SEIR <br />Page 5.6-4 <br />Based on best available data, impacts for hydraulic breakers, or hammers, and other non-transient <br />sources such as those associated with project construction shall be considered significant if the PPV <br />exceeds 0.2 in/sec. <br />5.6.3.2 City of San Diego Municipal Code <br />The City of San Diego regulates construction noise through Section 59.5.0404 of the City’s Noise <br />Abatement and Control Ordinance as follows: <br />(a) It shall be unlawful for any person, between the hours of 7:00 p.m. of any day and 7:00 a.m. <br />of the following day, or on legal holidays as specified in Section 21.04 of the San Diego <br />Municipal Code, with exception of Columbus Day and Washington’s Birthday, or on Sundays, <br />to erect, construct, demolish, excavate for, alter or repair any building or structure in such a <br />manner as to create disturbing, excessive or offensive noise. . . . <br />(b) [I]t shall be unlawful for any person, including the City of San Diego, to conduct any <br />construction activity so as to cause, at or beyond the property lines of any property zoned <br />residential, an average sound level greater than 75 decibels during the 12-hour period from <br />7:00 a.m. to 7:00 p.m. <br />5.6.3.3 MSCP Subarea Plan <br />The City of San Diego’s Multiple Species Conservation Program (MSCP) and MHPA adjacency <br />requirements, as well as associated guidelines produced by the U.S. Fish and Wildlife Service, <br />require that noise be limited to a level not to exceed an hourly limit of 60 dB(A) Leq or the average <br />ambient noise level, whichever is greater, at the edge of MHPA habitat during the identified sensitive <br />species breeding season of February 1 to September 15. <br />5.6.4 Issue 1: Noise and Vibration (Construction) <br />• Would the project result in or create a significant increase in the existing ambient noise <br />levels, which exceed the City’s noise ordinance? <br />• Would the project expose persons to or generate excessive ground-borne noise vibration? <br />5.6.4.1 Threshold <br />According to the City’s CEQA Significance Determination Thresholds, a project would have a <br />significant noise impact if it would result in: <br />• Exposure of people to construction noise levels that exceed the City’s adopted Noise <br />Ordinance, San Diego Municipal Code, Section 5.9.5.0404 (i.e., 75 dB(A) Leq).
